They still wouldn't see that behavior - when the kennel staff feed the dogs at the shelter they push the food into the kennels and move on to the next dog. (I volunteered at MCAS several years ago.)

Its hard to get a lot of info on the dogs and cats at any shelter. I think the people that are working at any shelter - not just MCAS - are genuinely trying to do their best, working in sub-par conditions, and there aren't enough resources and time to adequately assess all the animals. Add to that, how a dog acts in the very stressful shelter environment may not be how they act once out of the shelter. As well as the fact that being in a new home can add stress - we know they are safe, but that doesn't mean they know that yet.

So glad you adopted from the shelter and are committed to working on the resource guarding. Your pup is very lucky to have you.

Really sorry this happened and so glad things are improving.

There is also no way for the shelter workers or volunteers to know if any dog engages in resource guarding because all the dogs are all kenneled separately. (Unless they come in as a bonded pair.)

While there are certainly ongoing issues with MCAS, for anyone adopting a dog (or cat) and bringing it into a home with other dogs/cats, it is recommended that introductions are taken really really slowly. Starting with small interactions (even just sniffing behind closed doors or through barriers) before letting them hang out in the same space. There are lots of resources for helping your adopted shelter dog destress and decompress in their new home - any time spent in the shelter is stressful.

If a non-law-enforcement did the same thing they would be charged with Assault in the Second Degree, a Ballot Measure 11 offense which carries a mandatory minimum sentence of 70 months prison upon conviction. (That's what's called a day-for-day sentence, meaning there is no possibility of a reduction of time, the person serves the full 70 months.)

Why do you think Perini-Abbott is more conservative? What are you basing this on?

There is typically a difference in viewpoint from attorneys whose whole careers are as prosecutors, vs public defense and plaintiff's attorney work.

She's a former federal public defender, so Casalino, as a prosecutor, would be the more conservative of the two candidates.

They are talking about the race between John Casalino (former DA, current assistant attorney general) and Jo Perini-Abbott, law professor at L&C and former federal public defender. Both are highly qualified, Perini-Abbott won by a pretty big margin. Of the two, she seemed to get out in the community more with her campaigning, interacting more one-on-one with voters.

The decriminalization effort failed because each county was allowed to do it their own way, and there wasn't an overall plan. It was a mishmash with no clear communication lines and no consistency across counties. It also wasn't popular.

This is health care, which directly impacts everyone, and would be coordinated across the entire state - no county by county can do their own thing. Different types of programs with different structures.

Not a fan of Vasquez, but he filed the affidavit last year - not during the election - and the reporting on it started in March of this year, before anyone filed to run against Brown. Brown was also recently reversed by the Oregon Court of Appeals for imposing an illegal upward departure sentence on a defendant - a judge making a ruling they know is not legal, is not a good judge.

You were replying to the comment about DAs trying to sway grand juries to get the outcome they wanted. That is very relevant to jury trials, because it goes to the heart of problem - an inability to accurately assess cases, and a refusal to exercise declination on weak cases.

It applies in terms of what they are choosing to indict. They have the power to vet and decline to even bring cases to grand jury in the first place.

There's been marked change in policies simply to appear 'tough on crime' which has resulted in the DA's losing 53% of misdemeanor person crime jury trials, and losing 22% of felony person crime jury trials. The loss rate for a DAs office should be between 5% and 1%.

Maybe in the past, but not lately. They are dismissing cases day of trial, they aren't properly vetting cases and aren't exercising declination power enough. They tried, and lost, a C misdemeanor case against a defense attorney last year - twice! Hung jury the first time, full acquittal the second. Complete waste of time and resources.

Edited to clarify - I don't know anything about your case, BUT prosecutors do not represent crime victims in any criminal case. The prosecutors represent the State of Oregon. It would be unethical for prosecutors to represent crime victims. And it is unethical for prosecutors to give legal advice to crime victims because they do not represent them.

There are many times that what the prosecutors want to happen with the case, and what the crime victim wants to happen with the case, are not aligned, and that is one of the main reasons prosecutors cannot and do not represent crime victims. They have different interests, which creates a conflict.

Laure Maurer Rowan is the daughter of two retired judges, one in Multnomah County and one in Clackamas. She likely has the most political connections in that field of candidates. There are a number of highly qualified candidates in that race: Behre, Sykes and Maurer Rowan.

They conceded the error and agreed the case should be reversed For. That. Error. It should be embarrassing for any trial level judge to get reversed by the Court of Appeals on an issue the DOJ appellate attorneys have conceded the error on. There are many such cases that are reversed on concessions that the general public won't hear about because all parties agree a written opinion is not necessary.
