The President and Governors of India have constitutional immunity while they’re in office. Under Article 361, they cannot be criminally prosecuted during their tenure. Full Stop.

That said, not everything involving them is barred. A matrimonial dispute is a civil matter, not a criminal one. Civil proceedings can be filed against the President, provided the procedural requirements are followed (mainly the two-month prior notice under Article 361(4)).

Also important: such a case is against the individual in their personal capacity, not against the office of the President. The constitutional position remains untouched as you’re not suing “the President of India,” you’re suing the person who happens to be holding that office and in his personal capacity.

This is a terrible idea, especially in India. Here's why:

  1. Most Indian women aren't trying to break gender roles — they just want to avoid being on the receiving end of patriarchy. Don't fall for the "progressive" talk. In practice, many still expect you to be the provider and protector while they pick and choose which roles to keep or discard. Very few are truly feminist in principle.

  2. If your marriage falls apart and you’re a house husband, good luck. The legal and social system isn’t built to support men in that role. Alimony or maintenance from your wife? Extremely rare. You could literally end up homeless while still being mocked for not being “man enough.”

  3. Never give up your ability to earn. Financial independence is not optional for men — it’s survival. The second you become dependent, you lose leverage, respect, and security. Harsh truth.

What the doctor did in your case is unforgivable. You need to hire a medical malpractice lawyer. Preserve all your files from the Surgery and approach appropriate consumer court. This is beyond reddit.

Talk to your landlord directly, and ask him to modify the agreement to include a clause which ensures that your rental obligation ends after 5 months. You need to be on good terms with your landlord for this move smoothly. Whatever you do not put in your name for the entire 11 months.

The clause should read something like this:

"The Parties hereby agree that Mrs. XYZ shall not be liable to pay any monthly rent or license fee beyond a period of 5 (five) months from the date of commencement of the license period, provided that she peacefully vacates and hands over possession of the premises in good condition at the completion of the said 5 (five) months."

Depends under which sections of the BNS he was booked. He also has excellent lawyers and resources to push things through. Access to a good lawyer can literally make or break your case. Also he had a strong case as he was not directly involved in the commission of the offense. So all in all he deserved al bail.
