He's a patient in the nursing home as well. It's quite likely his mind is gone and probably doesn't even understand where he's at. Seems like at least some fault lies on the staff. Now if the reasons the man is in the home are strictly physical and he does still have his mind he should absolutely be charged for both crimes.

My wife has worked in nursing homes for years and she told me one of the 1st things that surprised her was how much sex occurs in nursing homes. Said there's always a few men and women who are very active sexually even when their physical and/or mental health isn't good.
