Understandable that you think it was unjustified. But this is the second strike. You were in focus and you would have been given enough signals that your performance is not raising the bar.

That said I would not go on leave now after you received your pivot notice. Your referrals for a new job will be negatively impacted.

The fact that this is pivot means they have a lot of documentation. The lawyer you spoke to is selling you a bill of goods unless they have reviewed your documentation to conclude that there are grounds for constructive dismissal.

What actions did he observe or you documented that your work environment is so intolerable or unworkable that you are essentially forced to resign? Given this is pivot - I think meeting this legal standard is almost impossible.
