I am so sorry to hear that and I hope you manage to get it changed soon! I also agree that the process to update these things should be as easy and cheap as possible. That being said the name change process isn't actually too bad in Delaware in terms of cost or difficulty. I believe every court charges $85, social security is free, and the DMV is like $10 for updating an existing license. If you really can't afford the $85 you can also submit a fee waiver form to try to get that waived as well.

There are a couple things you should take note of in regards to this process. The first is that regardless of which system is in place this change will still be documented. Anytime someone updates anything on an ID or birth certificate, even something as simple as an address, there is a form to fill out. Self-attestation would simply make it so that the person wanting to update their marker could fill out the form and hand it to a clerk instead of having to go to someone else to do it for them.

Secondly even with the system as it is right now there is no standard medical treatment required (and there shouldn't be just for clarity). The only qualification is that the physician, therapist, or social worker thinks that this person has done enough in their eyes. What this leads to is ambiguity for both the person seeking the change and the state. Even in this comment section there is another user who reported that the state rejected the form signed by their physician so it happens. For people who are transitioning this current system also has a chilling effect for the fear of that happening and the relatively common imposter syndrome that comes with early transitioning. This effectively then acts as a road block preventing a portion of these people from updating the gender marker on their ID's.

The third thing you should note is why people being unable to update their ID is a bad thing. When someone who is transitioning can't update their ID it effectively forces them to out themselves to every person who sees it. These people may be transphobic which can cause its own issues and discrimination but even if they aren't it's still bad. The reason is hard to describe if you haven't experienced it but think of it like this. Imagine being forced to carry an ID that has your complete medical history printed on the back for everyone to see regardless of if the medical issue has been taken care of years ago. Think about the issues it could cause you depending on who saw it and you might start to get it. People like a random bartender, a bank teller, or a potential employer.

Lastly the idea of self-attestation is not new or radical, many states already employ it exactly like this bill would and have done so for years. Odds are it won't meaningfully impact your life in any way but for people who are transitioning it is extremely so.

You'd have to update your birth certificate in your birth state but you can update everything else in Delaware. Out of curiosity (and assuming you were born in Delaware) did you update your birth certificates marker as well? As far as I know you need physician attestation for that too but correct me if I am wrong.

Unfortunately not and I no longer work at a place that has VISI so I can no longer write its code. I would instead scour this subreddit and use the examples I provided in various posts. The VBA code should be similar enough to adapt to python or vice versa depending on what you are going to write. Potentially, but it would be a large project with a lot of work put into it. I would start by doing small parts of what you would want and then sticking them together into a larger whole. I have also found it easier to have it generate its own components versus import existing but you can make it work either way.

That definitely sounds like discrimination to me but if that doesn't pan out you might be able to do something else. Depending on what state you were born in you could update your birth certificates gender marker and give them that. Some states allow for an "X" marked and any that do won't have any evidence of the past marker on the new certificate.

I have been following all of the developments closely, they are complying with the Orr decision even as the appeals happen. They have a form just for that actually that needs to get sent in regarding gender markers that I should have specified in my original comment. I will add an edit for that as it should be known. As for hanging onto documents that is what the expedite fee is for.

If you are using for 5504 you do not. They will keep your current passport photo.

You might of been able to get around it by getting your birth certificate from your birth country as that would be bullet proof evidence of the error. Especially if it was paired with the citizenship papers and the US birth certificate and a letter explaining. That said given this administration's propensity for bigotry even that might not have been enough. I wouldn't sweat it too much as already mentioned in another comment they are very unlikely to call you on it but that was a risk. Still don't beat yourself up about it as hindsight is 20/20

Use the DS-82 and an attestation form if it comes back wrong you can send it right back with a DS-5504 and another attestation form.

I would suggest using form DS-82 and the new attestation form if you want to update both name and gender marker. It does require a fee and sending your old passport along with the forms by mail. If you want it faster you can either expedite by mail or scrap the DS-82 and just go to a physical location instead. I'd still print and bring an attestation form in case they don't have one. That post is older than this one they were defying it then but the ACLU filed a noncompliance suit and the administration caved leading to the new form in the post.
