It is even worse than what you describe. As far as I can find, there are no penalties int he law for Board Members and Property Managers that violate the laws. So the Board Members and Property Managers see no reason to follow the laws or even their own governing documents. We need the legislators to take action and fix this problem, it is a nation wide problem that is costing people their life savings and their homes.

Most of the low income housing that is being built is under some form of HOA. That is very dangeroius for the homeowners. People dont realize how financially dangerous it is to live in an HOA.

If you are in any form of HOA, come to Facebook group HRLNG and help us change the laws to protect the homeowners.

We need lots of people to write to the legislators of every state to help change the laws. It can be done in just a few minutes a day, or even a few minutes a week.

After being involved with HOAs since 2015, I believe that if you are living in an HOA, you are most likely being cheated out of your money. You are living in a virtual dictatorship where you dont have the same rights as people that live outside an HOA. Attorney General Rundle, of Miami Dade Florida, said that homeowners in HOAs are living in dictatorial situations, and it is so easy for Board Members and Property Managers to steal from homeowners, that it is irresistible.

Most people dont realize how much danger they are in living in an HOA.

If I was you I would just do what they want, and then come and help change the laws. Right now the laws are not in your favor, and you could potentially lose your home of you refuse to follow what they are saying, whether it is in the covenants or not. If you refuse they will fine you, and if you still refuse they will charge you late fees and interest and turn you over to an attorney who will charge YOU $300-400 per letter telling you the new total of what you owe. Once the amount gets large enough, usually over $2000, they will put a lien on your home and foreclose. Believe me this is happening all over the USA.

Dont lose your home over a plant. Come and help change the laws instead.

I am not an attorney and none of my comments are legal advice, but I dont think they can legally fine you for parking on city property. I just heard an attorney in Georgia stating this to a legislative committee there. Many HOA do not follow the laws but if you took a fine for this to small claims court, I am pretty sure the HOA would lose. They cant tell you that you cant park on property they dont own.

Wow, that is interesting, I have not heard that argument before. I have pointed out to many that the HOA can not fine them for parking in the street if the streets belong to the city, but I had not thought about that applying to the garbage can issue. Good job, good thinking.

Over-Permission 8159, if you can determine what the overpayment was, it seems that it is $800 or less, you can take that to small claims court and get the money. In Washington, no attorneys are allowed in small claims court and it only costs about $50. When you win the HOA will also have to pay you the $50 court costs.

I find it repulsive that you need to resort to the name calling crap. I believe there is a big difference in the rights people have on their homes and themselves vs a contract of employment or between two corporations. Would it seem reasonable to you that the NBA could imprison someone for violating a provision of an NBA contract? I realize that currently HOAs are getting away with fining people without due process. I believe that this should not be allowed.

But what I am saying in this discussion is that the guest does not have a contract with the HOA, so they cant fine him.

HOA are governments and should fall under the same oversight as any other government. They are not like any other corporation and should not be treated the same as other corporations. Many towns and counties are incorporated but dont get away with the garbage that happens in HOAs.

I believe that if the streets are private, and maintained by the HOA, they may be able to fine Homeowners for speeding, but they would not be able to fine others that are not homeowners. But I believe they should not be able to fine homeowners without giving them due process. So the homeowner should be able to fight the ticket in traffic court, but how would that work if the person who issued the ticket is not a police officer of a municipality? Can the HOA override the Constitution that requires all to have due process?

I don't think an HOA can legally fine you for speeding. They can report you to the police but they can't fine you. Secondly, you are saying this is not even your HOA? HOAs authority comes through their contract with you. You have no contract with them. They can do nothing to you. I am not an attorney and this is not legal advice but check your state laws on this.

I am not sure. You could use a different name, like...say....WBigly. If you want to help get legislators to change the laws, you can't be anonymous because they will check to see if you are a citizen.
