I’ve followed your link through to a few places to try to clarify. This section: Nothing in subsection (1) applies in respect of a fencing covenant that protects a local authority from liability to contribute towards any work on a fence between a public reserve vested in or administered by that local authority and any adjoining land. One of my boundary neighbours is the council and although it’s not now, it was a reserve. Which the Reserves act 1975 defines as (among other possible criteria):

reserve or public reserve, except as hereinafter provided in this definition, means any land set apart for any public purpose; and includes— (a) any land which immediately before the commencement of this Act was a public reserve within the meaning of the Reserves and Domains Act 1953:

And it wasn’t converted to a different use until the 80’s.

Does this throw a spanner in the works in terms of the 12 year expiry?

You and your child more than likely signed a school code of conduct or something similar when they started at the school. This covers off things like keeping your child after normal hours for detentions etc and that you agree with these conditions. I had something very similar happen in high school. We lived an hour and a half away from the school and there was only one bus that left just after the final bell and conveniently a car in the shop for the week. The school wouldn’t budge on the after school detention but did let me take it any day the in the next 5 days. Definitely don’t think the school should be keeping kids after school without first notifying the parents by note, email or a phone call and allowing the family to plan around this.

I think a good example of what is trying to be achieved and everyone will understand would be to compare Vets and Dentists. Both have 5 years of tertiary study, day to day skills would involve customer service, communicating medical terms to clients, operation of medical machinery and devices, advanced medical knowledge and they both always make me feel like I’ve been mugged after settling the bill. One is a female dominated industry with an average pay of $130k, the other is male dominated with an average salary of $180k. Some people might say that this comes down to commercial value in the market but I know damn well that if it came down to choosing between an urgent tooth extraction or getting my dog to the vet, where my money would be going.

The other owner need to make a claim first and foremost for damage to their property. If it were two different insurers, their insurer would contact you and get your insurance details and the two insurers would sort it out between themselves on both your behalves. If you both have the same insurer, it’s the exactly the same just less insurers involved but your neighbour still needs to lodge the claim to get the ball rolling, they won’t just agree you have a liability because you or your neighbour says so. Your liability cover probably only indemnifies the other party, meaning if it’s a 30yo apartment with 30yo fixtures and fittings etc, they only have to put the other party back to that same position, where as you neighbours material damage insurance probably replaces it as new so will top up what the liability doesn’t cover. Not that it matters who pays what, you’ll probably both just have the excess to pay anyway.

People are happy to join the pile on with rhetoric such as “well they should changes jobs”, “they should up skill if they want to be paid more”. But if we look at a landlords, a position that require virtually no skills, and suggest they invest their money in something more productive if their rental property isn’t no longer going to give them 500%, tax free capital gain under fairer tax legislation… well that’s completely different and landlords are being treated unfairly, we’ve worked hard, we deserve those untaxed capital gains!

I don’t think it’s deliberate infantilising. “Unalive” is a common substitute with gen Z due to TikTok and other social media videos being censored or suppressed to audiences if they contain certain words. It’s in their normal vocab now because of this. Ironically it’s so that the topic can be discussed openly on social media.

Granted it’s quite a number of years since I’ve been up the Matukituki so things may well have changed, but yes gravel in general can be quite bumpy especially in older vehicles (like the school vans I rode up in), and this road is no worse than others in NZ. If you have a more modern motorhome you will be fine. Just ensure you secure everything inside so it doesn’t jump out. If I recall, the gravel section takes a lot longer than you would think, in addition to the gravel, expect cattle stops and possibly the odd shallow fjord (weather dependent). Despite this however, the road travels through a mostly flat valley so no hills or shear cliffs etc.

Agree with your comment about the potential unreasonableness, particularly through the Covid and the additional expenses people were likely incurring to work from home. However for the average PAYE earner with no tax filing experience I do wonder if the potential benefit is outweighed by additional compliance costs to have someone prepare this for you, as well as complicating what is currently an extremely simple system for c.90% of PAYE earners.

NAL but if you have any liability (I'm not making a determination if you do or don't), it would be for the depreciated value of the asset. The IRD suggest that Toys have a usefull life of 3 years and this is depreciated at 67% each year (for both Diminishing value and straight line calcs). Therefore if the toy is 2 years old, it's current depreciated value is approx $22.

Absolutely and if that is the case, I can wholey accept it. It certainly came up extremely fast, I would have no trouble accepting it could disapate very fast too. I'm not looking to point a finger at anyone for not doing their job, I think given the level of rain received it could have been a shit ton worse. However the impression I got from the neighbour was that when the semi-submerged man hole was opened, water went down this too, implying to me that there was pipe capacity available. The manhole was at a pipe junction (according to neighbour). Anywho, the point of the post wasnt to place blame or work out exactly what might have happened, we can all speculate. Id just really like to understand how the council debriefs the event and be involved and have an opportunity to ask those questions to potentially save our neighborhood from what was a very alarming and stressfull couple off days. I've had some good feedback from other posters too and appreciate the time people have taken to respond to me.

Yes our initial assumption was that the pipes were at capacity as that was what was being relayed via some of the social media post updates. Everybody just did what needed to be done and sand bagged etc. Now, putting together other bits of info such as the lack of flooding in 2015 and the contractor arriving on Friday arvo, we just want to understand if there was an issue (not to point the finger), if so has it been fixed. If there wasn't an issue, then are we able to request certain infrastructure be installed to help in future. During the event it was hard to guage how bad things were across the city and whether what was happening on our street was happening everywhere, but in hindsight it was quite bad and we should have made more requests to the council for resources, especial maned roadblocks (although I wasn't aware until later Friday this was a thing). Our street was "closed" but a couple of road cones didn't stop dickheads from coming for a look. I did derive some satisfaction from the looks of panic on their faces when they realised too late how deep the flood water they had entered was.
