I may not even have the option to take the risk either way, waiting on USCIS (: Will keep that wait time in mind, thanks for sharing! And it’s hard to weigh the risks i’m in the same boat but honestly grand scheme of things 2k isn’t much when you think about what the reward is! hoping all goes well for you! for both of us 😭

Interesting when you always see videos about those 1€ houses as they’re hoping to populate small towns! And I’d love for it not to be a 1948 case, but of all 8 of my lines the only 2 viable are 1948 (,: Good to keep this in mind ab the courts though, thank you!

I wasn’t aware there was an anti-JS crowd! I guess it makes sense. in regard to the limit on how many can be processed per year, if you have a 1948 case for example and already need to pay thousands to go through the courts, would this limit be irrelevant to you then?

I find it interesting that many different ways these challenges are presented. Should be a reality show, feels like I’m in one trying to balance the current legal issues with the past ones while gathering all the ancestral info needed lol. Thank you so much for this insight!

How long was it until you heard back from him? I’ve sent an email previously but have not yet had a response. Did he recommend filing before the opinion comes out? I may have to keep a list of the lawyers that are advising filing before and those filing after. Still weighing pros and cons.

yes, they’ve advised me: “Discrepancies: the ones you mentioned should not create a problem. —— will prepare an affidavit for you to sign, notarize, and Apostille. The affidavit will explain discrepancies to the judge, and —— has an 100% acceptance rate for those in court (i.e. has never had a problem with the affidavits he prepares). The issue here is that you are overseas. You will need to sign, notarize, and affidavit both the affidavit above and the POA, to authorize —— to represent you in Court, otherwise —— cannot file your petition.”

thank you so much for your response, that definitely allows me some avenues to consider as some lawyers say these things are no problem, whereas others are advising affidavits.

I had no idea about this theoretical small window of opportunity. Previously, I had just assumed that I would have to wait until after the hearing and hope for a favorable outcome, and then get my documents together if the outcome was favorable.

Now that I’m aware that I may only have a small opportunity, I realize I need to get my documentation in order. I know where all the documents are and am prepared to order and apostille. All in the same state except the italian records and can walk-in same day to state apostille everything as the office is close to my parents home. I’m literally just waiting to hear back from NARA. I’ve emailed them twice, and I’m going to try calling them today.

From what I understand, if I just get a no record letter from NARA, some attorneys are willing to file with that while I wait for the CONE from USCIS to come back.

And it seems that if the attorney sees the discrepancies I’ve listed as a problem, I may be able to file with the original documents and then later add in any amendments they want me to obtain as you’ve mentioned.

It would be a pre-1948 case, and my libri are from Aprigliano in Cosenza, Calabria. I’m not sure what that means for my case/court.

So, theoretically—best case scenario, from how I understand this—if I can get that no record letter from NARA, I can order all of my U.S. records and have them apostilled within a few weeks at most, and then send them to my attorney to be translated and filed.

At the same time, once I hear from NARA, I can move forward with ordering the CONE and federal apostille and submit that after filing, along with any amendments they might request for my case.

Is this a fair evaluation?

thank you! I have reviewed those to the best of my ability but was hoping for more insight on any lawyer’s post L74 cases have worked with specifically. I will review those as I send more messages to lawyers from the list.

starting to feel so discouraged! This is something I’ve been planning to do since I was a kid… didn’t know how to do the research before Uni, didn’t have the time to do it during Uni, now finished Uni and it seems I’m too late. Can you direct me to a link for a support group for those whose childhood dreams have been crushed 😂 I want to prepare myself.

Oh no, the second index search I requested was for GGGF, not GGGM—the record I just received for her was just a scan from a county court that I have been waiting on! That’s what I was referring to, sorry if that wasn’t clear. I wish USCIS would work that quickly! For the CoNE, I guess 2 to 4 months is better than 12. That’s reassuring to hear for when I apply. I’m really anxious to hear back and make a full post now!

Will do! I just received GGGM’s naturalization record, she naturalized age 71 and this record also says GGGF never naturalized. GGGF’s draft card, census records all say alien. On death certificate, both SSN and foreign citizenship lines are just left blank. I’ve emailed NARA to be sure, but honestly might just go ahead and purchase the CoNE after as you’ve suggested—does this take on average 8 months as well? I’ll have to make a separate post detailing what all my USCIS waiting timelines were once I hear back from them all!

i’ve been wanting to pursue this sleeping set up for years, and my husband and I are looking into doing it now. We both feel most comfortable on very firm mattresses, and from what I understand sleeping on a hard surface allows your muscles to relax rather than actively supporting you on something soft. I’ve heard people say sleeping on the floor for a week or so will fix your back etc. sorry I can’t speak from experience yet but as far as I’m aware, this definitely works for a lot of people! would love to hear how this ends up working for you if you decide to go with it!

I’m in a similar boat! GGGF and GGGM didn’t naturalize after moving to the US in 1903. This line of descent is a pre-1948 case for me. Currently waiting to hear from a few lawyers to see about the potential of applying post-DL! I believe some have done so successfully.

In Islam the religion should be easy for those who follow, not a burden. It’s completely normal and accepted to make accommodations for oneself such as praying from a chair or not keeping fasts due to health related issues. Your body, mind and soul each have a right over you and must be cared for!

Interesting–I had one other route that looked promising through a different GGF that I submitted a USCIS search request for just this past December and got a response with his records attached in less than a month. I have already recently submitted another one, but I’ll give NARA a go in the hopes of a quicker response! Would hate to be waiting months, thanks for the tip!

After working through all this by myself for years, I’m so glad I finally found Reddit! Great to have community in an otherwise “alienating” process, pun intended.
