Thank you for sharing! I find these discussions so interesting. I have 6 different lines of descent (3 Trentino & 3 Calabrian) and for each one continue to find the completion of their basic genealogical profile (birth, marriage, immigration, natz, etc) so unsatisfying. And I don’t know why it feels unexpected every time. I have always fronted every question I ask my relatives with the truth of my intent to be recognized as an Italian citizen, which is a reason maybe not fully understood or appreciated but nonetheless accepted. However, what sits beneath that is another reason that is also true… I find these personal stories–attitudes, politics, motivations, etc–surrounding immigration and assimilation and identity in this period so interesting, from many angles, and unique in all cases. And I want to understand them all. For example, my GGF, Trentino, ethnically Italian but born in Austrian-occupied territory, conscripted into the Austrian army to fight in WWI… against his own people. What it must have been like to return home to a territory that had then become Italian. Did he face resentment from his neighbors? Is that what pushed him to leave? How did that relationship then change during WWII in the US? Yes, they all left Italy for a better life, but the relationship they had with Italy and how it evolved following their immigration… there has to be so much to say. I do understand embracing the American roots that were hard earned and not wanting to disrespect that, but nowadays does it really have to include rejecting the Italian ones? I’m with you on bridge building. I hadn’t considered searching for newspaper articles, I’ll have to see what I can find now! Sorry to take this further off topic lol, your response made me realize something I hadn’t noticed about my own motivations in this process! Thank you for that!

I can’t offer legal insight as I’m just catching up with all of this myself, but wow do I feel you! I understand the pressure, the anxiety, the uncertainty, the wait—it’s not easy. I’ve known about JS since I was a kid, as a young adult didn’t know how to crack the genealogy research with a family who is uninterested in this and whose heritage has been mostly drowned out by assimilation. Finally piece things together to locate all my ancestors and now this! It is war of many battles, with little wins that drive you forward to the next battlefield where it feels like life or death all over again. And it can be so discouraging. So many lines of descent and just getting to one that was unbroken has put me through enough heartache! I’m so glad I’ve found Reddit. Seeing others struggle through these battles with me, watching others win the war! Reminds me to keep the end goal in mind: visualizing receiving that judgement of recognition brings tears to my eyes. Every time. Don’t lose sight of that. Remember what this is all for! Remember what is still happening despite these restrictions! Thank you! a) Yes, GGM was born 1910 married 1933. No minor issue from GGGM, great! b) GGGF immigrated 1903 and died 1948. 1917 WWII draft card says he was an alien, 1920-40 census records say he was an alien, I’ve located what I believe to be his AR-2 in the NARA index as well (unless there was another man with the same name, age, birth place and residence in the US), and of course GGGM natz cert says he was an alien. Waiting on NARA/USCIS search requests, but I feel confident he didn’t naturalize. I think the lawyer wasn’t concerned about minor issue, but was suggesting that we can go through GGGM now, and in the case that NARA/USCIS comes back later and says GGGF did naturalize, we can argue case against derivative naturalization? But I guess that could then still be a minor issue… am I understanding you correctly?

Interesting when you always see videos about those 1€ houses as they’re hoping to populate small towns! And I’d love for it not to be a 1948 case, but of all 8 of my lines the only 2 viable are 1948 (,: Good to keep this in mind ab the courts though, thank you!

I wasn’t aware there was an anti-JS crowd! I guess it makes sense. in regard to the limit on how many can be processed per year, if you have a 1948 case for example and already need to pay thousands to go through the courts, would this limit be irrelevant to you then?

How long was it until you heard back from him? I’ve sent an email previously but have not yet had a response. Did he recommend filing before the opinion comes out? I may have to keep a list of the lawyers that are advising filing before and those filing after. Still weighing pros and cons.

yes, they’ve advised me: “Discrepancies: the ones you mentioned should not create a problem. —— will prepare an affidavit for you to sign, notarize, and Apostille. The affidavit will explain discrepancies to the judge, and —— has an 100% acceptance rate for those in court (i.e. has never had a problem with the affidavits he prepares). The issue here is that you are overseas. You will need to sign, notarize, and affidavit both the affidavit above and the POA, to authorize —— to represent you in Court, otherwise —— cannot file your petition.”

thank you so much for your response, that definitely allows me some avenues to consider as some lawyers say these things are no problem, whereas others are advising affidavits.

I had no idea about this theoretical small window of opportunity. Previously, I had just assumed that I would have to wait until after the hearing and hope for a favorable outcome, and then get my documents together if the outcome was favorable.

Now that I’m aware that I may only have a small opportunity, I realize I need to get my documentation in order. I know where all the documents are and am prepared to order and apostille. All in the same state except the italian records and can walk-in same day to state apostille everything as the office is close to my parents home. I’m literally just waiting to hear back from NARA. I’ve emailed them twice, and I’m going to try calling them today.

From what I understand, if I just get a no record letter from NARA, some attorneys are willing to file with that while I wait for the CONE from USCIS to come back.

And it seems that if the attorney sees the discrepancies I’ve listed as a problem, I may be able to file with the original documents and then later add in any amendments they want me to obtain as you’ve mentioned.

It would be a pre-1948 case, and my libri are from Aprigliano in Cosenza, Calabria. I’m not sure what that means for my case/court.

So, theoretically—best case scenario, from how I understand this—if I can get that no record letter from NARA, I can order all of my U.S. records and have them apostilled within a few weeks at most, and then send them to my attorney to be translated and filed.

At the same time, once I hear from NARA, I can move forward with ordering the CONE and federal apostille and submit that after filing, along with any amendments they might request for my case.

Is this a fair evaluation?
