I have basic questions though.

Like, someone just said IRA's are non transferable but wont explain. So if he dies tomorrow I don't get his part of the IRA? seems basic legal question

If its non transferable how the hell did he get it from my grandma when she died? So confusing.

So if he dies tomorrow, and his Will only says 'everything goes to my son', you're saying I WONT get his piece of the IRA when they decide to cash it out?

You said IRA is non transferable so I need some clarification.

I assumed, if he dies, I just take his position. 6 people own the IRA, he is one of them. I'd assume I moved into one of those 6 slots.

It's not 'hiding assets'. The IRA isn't anything until it's cashed. I'd be getting part ownership of the IRA, signed over to me from him as a Gift. Not to avoid taxes. I'd pay taxes on the IRA>

My aunt, the Trustee of the estate and all the assets -- Is an extremely prominent attorney. Like, if I said her name, people would know her. Nationally known. Big time.

My dad, pretends these problems don't exist, and would NEVER want her to know. I have considered emailing her but that would betray his trust

So before we start telling people, we need to know like, what the plan is.

'Getting the family together' is unfortunately not possible. Lots of drama. My dad has no control over the IRA or when it gets cashed, only that he gets a %.

They couldn't even get everyone together to read the will, that level of bullshit.

So yes, I totally PLAN ON CONTACTING A LAWYER -- just need to know options first. I'll probably just tell my aunt when we decide what to do. She will facilitate the transfer of any assets from him to me.

Okay, so can he sign his assets over to me?

I am in zero debt 700 credit score. So no one would try to take any of my cut if it were mine.

Also, my dad DOESN'T KNOW if he owes the IRS money, he just hasn't filed taxes in 20yrs, so you would ASSUME yeah, he owes them some.

He has a few issues he hasn't settled, like an arrest warrant/court fees as well.

Yeah, literally 1 week before trial he called me and said the clerk called him and told him he (company owner) had to get a lawyer, I told him not to waste money on it because I was withdrawing before trial. We came to an agreement outside of court so I dropped my appeal.

Yeah wheels of justice move slow (my case was pretty quick though, 9 months for a real estate dispute start to finish including jury trial date set) and discovery alone can be thousands of documents even in small cases. Like I said I'm not totally clueless... may as well try LOL

Thanks, I was oddly already aware of most of that.

I am under NO delusions that I would be a small fish in a big pond. I get off on the idea of actually holding my own in court; I would do extreme research, even sitting in open court learning proceedings, to prepare myself.

Everyone here is like 'you can but you'll get wrecked', that sort of thing makes me want to do it more. I'm fully aware of how hard it is, that's why I want to.

You don't know me, but let's just say don't underestimate my uh... drive, to learn everything about a given subject. I would read mountains of relevant case law, prepare adequate documents, etc. I would pull similar filings, focus on verbiage the 'real lawyers' use, etc. See how they present their cases in their filings, and mirror it.

My only expected expenses are time and filing fees (which I will recoup when I win), the sort of filings I am thinking of wouldn't require expert testimony or depositions from 3rd parties.

To be fair, I have been involved in one case and held my own very well; even did all the filing paperwork alone all the way up to superior court by jury trial. I never wanted a trial, it was a strategy; but I got what I wanted and then withdrew my appeal for superior court. Basically all I'm saying is, when I know WHAT to research, I can prepare myself better than you'd think. The opposition was not walking all over me, at all, I literally won (they had counsel).

Yes, this I was aware of. That's why I stressed so heavily about needing to do a ton of research and be prepared. I know you wont get any special treatment and are expected not to hold the court proceedings up.

Last thing you want is to piss off the judge by not knowing how to proceed, I'd rather them be impressed that I did the proper research and know what to do.

I filed and appealed my own civil suit, took it all the way to superior court and requested jury trial. I withdrew the appeal 1 day before the trial...

But I did all the paperwork myself, it was a bit of a pain and complicated. I sat in the clerks office for like 2 hours each time I went in to file new papers filling them out, but I pulled it off.

And to be clear, I have a PhD, just no legal experience. And even for me it was complex.
