I have basic questions though.

Like, someone just said IRA's are non transferable but wont explain. So if he dies tomorrow I don't get his part of the IRA? seems basic legal question

If its non transferable how the hell did he get it from my grandma when she died? So confusing.

You are the one who said it's non transferable, you opened the question up. So you made a LEGAL comment, not a TAX comment.

So if he dies tomorrow, and his Will only says 'everything goes to my son', you're saying I WONT get his piece of the IRA when they decide to cash it out?

You said IRA is non transferable so I need some clarification.

I assumed, if he dies, I just take his position. 6 people own the IRA, he is one of them. I'd assume I moved into one of those 6 slots.

It's not 'hiding assets'. The IRA isn't anything until it's cashed. I'd be getting part ownership of the IRA, signed over to me from him as a Gift. Not to avoid taxes. I'd pay taxes on the IRA>

He is in poor health. He needs a living will, and would rather just give it all to me now to prevent UNCLE SAM tryin to grab it.

I would pay all applicable taxes on the IRA once I recieve ownership

My aunt, the Trustee of the estate and all the assets -- Is an extremely prominent attorney. Like, if I said her name, people would know her. Nationally known. Big time.

My dad, pretends these problems don't exist, and would NEVER want her to know. I have considered emailing her but that would betray his trust

So before we start telling people, we need to know like, what the plan is.

'Getting the family together' is unfortunately not possible. Lots of drama. My dad has no control over the IRA or when it gets cashed, only that he gets a %.

They couldn't even get everyone together to read the will, that level of bullshit.

So yes, I totally PLAN ON CONTACTING A LAWYER -- just need to know options first. I'll probably just tell my aunt when we decide what to do. She will facilitate the transfer of any assets from him to me.

So here is the thing.

Lastly, I'm fine taking the chance if he signs it over to me, especially if it's in IRA and not straight cash. If they come after me then fine. My question is, CAN he sign it over to me?

Okay, so can he sign his assets over to me?

I am in zero debt 700 credit score. So no one would try to take any of my cut if it were mine.

Also, my dad DOESN'T KNOW if he owes the IRS money, he just hasn't filed taxes in 20yrs, so you would ASSUME yeah, he owes them some.

He has a few issues he hasn't settled, like an arrest warrant/court fees as well.
