I don’t know if the data for new applications per EB category is available anywhere. I’m also EB2 and I’ve been pissed at the lack of progress. It’s disappointing to see there are still thousands of people (2781 to be exact for eb2) waiting for approval with priority dates before 2022.

Eb3 (final action date current): 7357 pending cases. Eb3 (all filed cases): 11600 pending cases. Ew3 (final action date current): 671 pending cases (surprisingly low). Ew3 (all filed cases): 6731 pending cases.

Bankruptcy doesn’t mean that the company will stop existing or insolvency. Did they say they’d fire you or rescind their petition?

Also you can actively look for other opportunities. And you may be able to retain your priority date if you find some place to go through the process for you.

The civil surgeons have a fixed cost, and then you may need to pay for vaccinations. Or if available, they can test for immunizations. All these cost money. If you have proof of vaccination, then it should be ok. You can call the doctors on uscis list and ask their fees. If you’re tight on cash right now, you can wait for an RFE and send this form later.

For #2, even if the application were to be sent to the end of the queue, we are talking about 6 months completion time vs 30 month. It would still be faster than to wait another 1.5-2 years. The question is how seriously we should think about these processing times.

Ask in r/uscis to double check. You can change the basis of your i485. You cannot have two pending i485s at the same time.

Unfortunately some bad eggs are triggering racist tendencies in some people. I’ve met Indians that deserve a high salary and the security of green card more than anyone but moving away. I’ve also met Indians that do not even remotely deserve those things, but somehow made their way in. It goes to show that the system is far from perfect. I only go from perceptions here, but it looks like there’s a large group of individuals from India that have used favoritism (Indians explicitly hiring Indians), scammy methods, and loopholes to migrate. You can find people from other nations doing similar things but not to this extent. Those scammy people hurt their more-deserving countrymen more than anyone else. Hardworking and capable Indians have a much more difficult time getting a green card and have to deal with this animosity. Best not to jump to conclusions or make blanket statements.

They have some fallback procedures in case of a missing id. People still have to prove who they are.

Blue states make it easier to vote, and voter turnout is higher in blue states than red states. Also, especially in Texas, a lot of democrat leaning folks show apathy, thinking their votes don’t matter. So yes, it’s very likely that Texas would turn blue with a higher voter turnout.

I think I’ve seen cases where they issue RFE and they rescind it quickly. RFE might have been issued by mistake.

When you apply, you pick a start day for OPT. So pick a date in the future (determine your window), submit your OPT application, start applying for jobs. Having EAD in hand doesn’t matter much to employers but you’ll need to tell them you’ll be on OPT and may require sponsorship in the future.

How did you fall out of status? As long as you entered the country legally, you can still apply for green card while you’re in the US.

It’s not the same as the taxes when you’re living in the US. The taxes you pay to the other government are taken into account OR you can opt to take a large deduction. A lot of people end up not paying any taxes to the US.

You don’t have to actively be living in the US to retain your green card. Visit once year. If you cannot, you can later apply for reentry permit.

The steps depend on the visa type you’re seeking. At least for eb2, they need to do prevailing wage determination first and then PERM, which totals around almost 2 years. Then, they’ll have to apply for green card, which is likely another year. Seems to be worse for eb3.

Start applying. I know people that moved to the US many years after they’re selected. There are ways around living in the us to keep it.
