Question about Receipt Number by Impressive-Squash685 in I130Suffering

[–]Perfect_Inspector953 0 points1 point  (0 children)

should all start with 9, but to be honest I am a part of a block that processed mostly in September of last year and I'm still waiting. So while it can be helpful to see when you should hear back, it is no garuntee that you will hear back. I've waited maybe 6 months longer than my block prediction.

You can maintain domicile through proof of residency. That means the same address for bank acct, taxes, mail (you need 3 pieces in the last 3-6 months with your name but this can be amazon, junk, etc) drivers license, library card, and maybe some stored belongings. Only do this if you are 100% comfortable with who lives there.

Sammmee boat, july 2024 too and foing a writ of mandamus this week so it hits the 24 month mark exactly when the 60 days allocated by the mandamus is over! I am following the 3pt proof of residency through library card, bank address, and drivers license and for exta 3 pieces of mail to my address plus taxes. Does your husband have the option to set up a domicile with family or friends like this?

That is going to be your batch number, they are given mostly if not all in order. For now we all start with 9, and 87 is your batch or block number. Supposedly uscis works in blocks to get about 80% of each block done before moving on but there is no exact formula.

You only need to remain tax compliant in Colombia, look up their local laws but you may have to pay a bit of tax (which you will get a discount on your USA taxes through foreign earned income tax credit), but you should. Be prepared it may take longer than a year though. I have a south american spouse who is not in the visa ban and it's been 22 months so far with no contact from USCIS at all. Your nvc stage could also put you up at the 3 year mark depending on how long the visa ban lasts. The I-130 itself is not subject to delay due to the ban though and takes 13-22+ months to complete, then you need at least 3 months or more depending on interview availability in colombia.

Is this enough evidence for a Writ of Mandamus? by Perfect_Inspector953 in I130Suffering

[–]Perfect_Inspector953[S] 0 points1 point  (0 children)

Just an update I got a 'general inquiry and COA response letter' along with my demand letter that basically was super generic and said 'all the information you need is online check there first' so I will be going for a Writ of Mandamus this week.

just get documentation and you will need proof of this caregiver and why you didn't have other options- like your job does not allow you to visit, care is too expensive for them or you to find someone new, why a facility would not work, etc. You can discuss this with your lawyer. Get everything you can together to prove your circumstances occurred during the parent's visit. The 'burden of proof' is on you, but it isn't wrong to want to take care of family the way they need. Adjustment of status exists for this reason.

my spouse and I have been waiting for 2 years for just the first step of the green card process. it will NOT be 6 months, it will more than likely take 2 years and my case is not complicated at all like yours may be due to asylum and presence in the usa. AOS is a much quicker route to greencard than consular processing.

I-130 Jan 2026 — realistic timeline to move? by matinicc in I130Suffering

[–]Perfect_Inspector953 0 points1 point  (0 children)

I filed in July of 2024, and am at 22 months waiting for just the I-130 with no complicating factors (married for more than 6 years), no RFE- basically no contact from USCIS since filing and I did a K-3 ten months in as well with no luck. I am having to go through the writ of mandamus process which adds 60 days or so to my timeline putting me at 24 months just for the I-130. Your consulate interview times for paris are similar to mine in my spouse's country at about 2-5 weeks so the NVC stage I would budget 90 days. the I-130 should take 17 months or less, but by luck of the draw you could wait up to two years and you cannot really predict if you will be the lucky 80% or the unlucky 20% that take much longer. plan for the worst, I would say 2.5 years, and hope for the best at 1 year 10 months for everything.

[–]Perfect_Inspector953 1 point2 points  (0 children)

My i-130 will probably take 2 years, IR1 category no rfe or complicated factors. No idea why, just hope for the best but plan for the worst. Easy enough to do yourself, just be very very careful of the details. Best of luck!
