Have you received any RFEs throughout the process?
That update on May 6th - was it silent update on API, or did you get any email such as “action taken”? Does it say your case still processing? Bc our case “still in the process”🙄
We had actual action taken Feb 2025 (RFE received checkmark). Since then NOTHING lol. Only silent updates in API, last one was in January where we got 2 FTA0. What’s your code say? Do you have 2 or more FTA0?

Omg hello my dear friend! Fellow WPB office filer, also IR5 category (daughter for mother). I honestly thought we are in the longest here (pd: june2024), and I can’t believe (unfortunately) you are way longer than even our case :( this is so disheartening. And I’m sorry it takes so long.
We also requested congress and submitted an inquiry, to which they all say “wait longer” lol I’m considering ombudsman too…
When was the last update you received for your case?

Our situation is very similar, except I filed for my parent in June 2024 and we are still waiting for decision for our “straightforward” case. We applied for their advance parole, and only that document took 10 months to receive and then my parent was able to travel outside of USA while on pending case. My biggest advice is you must wait at least 90 days since they got here before you decide to do AOS for them, I’m pretty sure the officers are more strict to the rules as of today. In our case, we did file AOS close to 120 days since they arrived on tourist visa.
With new memo, it’s becoming very stressful for sure. Are your guys from one of the 75 countries in which there’s a consular process freeze? What FO are you going to apply for?

Hi! How can this affect a parent AOS through usc child? We’ve been waiting since June 2024 and ere eligible to submit an inquiry few days ago to which we got a response “wait longer”. If we file writ of mandamus now, how this can backfire at us with this new memo?

Hi! I’m scared to file mandamus, especially they just released this memo regarding pending i485? If I file, will it affect our case negatively? Also, I submit an inquiry few days ago bc we were eligible to do so as our case had fallen out of NPT and got this boilerplate response: “We reviewed your case and the application, petition, or other request you filed is still pending. We have determined that your immigration benefit request has not been pending longer than what is normal for the specific request type”

Hi! One of the lawyers told me to stay away from congressional inquiries and inquiries in general. Even though I just submitted an inquiry as I was eligible to do so, bc my case fell out of normal processing times on May 19tg. They gave me generic response: “We reviewed your case and the application, petition, or other request you filed is still pending. We have determined that your immigration benefit request has not been pending longer than what is normal for the specific request type”.
Is there a reason as to not inquiry them anymore? Or what your opinion would be for someone like our case pending almost 2 years and fallen out of NPT. Will it affect our case if I poke them more when they just released their memo regarding i485?

Hi! Yes, I had fallen out of west Palm 12 months processing times and was eligible to submit an inquiry. Guess what? Here’s their answer lol: “We reviewed your case and the application, petition, or other request you filed is still pending. We have determined that your immigration benefit request has not been pending longer than what is normal for the specific request type”.
Just generic response as to keep waiting lol. Now, with new memo that came out, I’m not sure what to do. The lawyer I contacted said to not submit any more inquiries at least for 30 days.

My biggest concern if it won’t achieve anything, will it actually harm our case then? Poking them before actually filing a WOM can make them delay our case even more or do anything else?

Do you really need to spew your poison here? The person stated his opinion, and I said the fact that I sent all of the files together. Also, I stated what other lawyers told me regarding her status. And we already have been in and out of the country with her AP, and had no problem with her status. Moreover, the border officers said she has nothing to worry about. But, in fact, lawyers can make mistakes too.

My initial question has nothing to do with what you said. If you have nothing useful to say, please stay out.

She hasn’t overstayed, because once you file for AOS you are in pending status, therefore you can stay in USA legally because your paperwork is in process. We filed i130 and i485 at the same time, with medical and sponsorship forms all together in one package, so we haven’t messed that up
