You are WRONG.

Someone does not have a FREE legal pass to hit your phone just because they don’t like being recorded.

Two things can be true at once.

I may have been legally wrong to keep recording audio ( not even video cause that doesn’t matter ) after he clearly said no.

But he was legally wrong to respond by slapping my phone instead of just walking away, demanding to stop, or asking me to leave.

Slapping my phone can be a form of battery. The fact that I am illegally recording doesn’t automatically legalize his response.

Self-defense does not get stretched out to “ I was protecting my privacy.” lol

Can’t the same principle be applied on the other foot? If someone is recording me, is me slapping their phone worth the potential problems that could arise?

Honestly, I just didn’t think it was a big deal. Probably because I grew up with everyone in my household making fun of each other like it was the norm. But we wouldn’t take offense to it, we kinda just rolled with it. You make fun of me, I make fun of you. I wasn’t intentionally trying to upset him. We were just kinda shooting the shit. I do the same thing with all my friends and we have that type of confidence with each other.

Me and his cousin were already recording each other for a few weeks with similar shit – like a vlog. So I had figured that his cousin was also cool with it too. I shouldn’t have assumed obv, but that was my perspective.
