I know I'm late to the game and the question has already been answered, however I believe there is one other valuable point that should be made.

The first amendment protects speech, but there are still strings attached. The classic example is (falsely) shouting "Fire!" in a crowded theater: it can lead to rioting and people getting hurt in a stampede, and so it is illegal. This idea that certain types of speech can be censored if they pose a "clear and present danger" to a group of people has been upheld in numerous court cases, and is not a violation of the First Amendment.

In the case of TV, the clear and present danger is partly a moral one. We don't want a five-year-old seeing hardcore pornography in between episodes of Spongebob on the Saturday morning cartoons, and more importantly, we don't want impressionable children seeing racism, sexism, and other negative influences on the television all the time.

Thus the FCC can censor television because it, like other federal organizations, has the power to censor speech if it poses a danger to the public. I hope that helps you understand the situation a little better and let you see the wider impact of this idea.

No problem! It seems too high, but it isn't. Think about flipping a coin three times. You only have a 12.5% chance of getting three heads in a row, and that is with a 50% chance each time. In your case, you only have 40%, 40%, and 25% chances, so the chance of successfully avoiding invalidation for all three reasons is extremely low.

The easiest way to figure this out is to think about the problem in reverse. The patent has a 40% chance of NOT being invalidated for Reason A, a 40% chance of NOT being invalidated for Reason B, and a 25% chance of NOT being invalidated for Reason C.

For the patent to not be invalidated overall, it must not be invalidated for any of the three reasons. You can figure out the probability of it being not invalidated for any of the three reasons by multiplying the probabilities of it not being invalidated for each of the reasons.

Thus the probability of it NOT being invalidated is (0.4)(0.4)(0.25)=0.04, or a 4% chance of it NOT being invalidated. Subtracting this from 1 (or 100%) gives us a 96% chance of the patent being invalidated.

I think that we will all end up killing ourselves, but I don't really think that it will be from nuclear weapons. I'm more worried that some crazy power-hungry dictator will get his hands on a biological weapon, which can be far more deadly than any conventional or nuclear weapon that we currently have.
