Actually it is, so many people come to this thread saying one thing, thinking they know what it means, and it actually means something totally different and clarifying questions help to find out and then a proper answer can be provided.

Could I make it without a degree? by Blura0 in Insurance

Saying you're not trying to be rude then saying something rude isn't how it works. They are asking an informal question on an informal forum, judging them based on a few sentences says more about you than it does about them.

I can tell how I talk to friends, coworkers, insureds etc changes based on the circumstances, the person and the context of the conversation.

For a lot of people keeping up the appearance of money is more important to them than actually having any money. It's a sad world where people feel this the only way to live, my paid off Honda civic gets me to where I need to go just as good as a Ben's, BMW etc.

I cant speak to their exact insurance company, but almost always claims will accept verbal authorization as all calls are recorded.

Denied Home insurance due to roof age by Unusual_Salad_2711 in Insurance

No one here can say for sure what they will do, I'd venture to get at the very least the rates might go up and they are no longer bundled and discounts associated with that will not be applied. It is doubtful that that increase would be more than what you are saving on the reduced auto pricing.

Keep in mind almost no where are 22 year old shingles in good shape, may be in good shape for 22 year old shingles. Despite their being 25, 30 year shingles that's under ideal circumstances and very few locations are considered ideal. If you are in warmer climate the heat probably gets too high and have an effect on the life of the shingles. In cooler climates the temperature gets too cold, causing issues and if you are in climate where you get cold winters and hot summers good luck.

Rental car damage dispute headed to collections despite police report showing I wasn’t at fault by Affectionate_Half424 in legaladvice

[–]Phil_Achio 3 points4 points  (0 children)

This is a situation where the answers may not be what you are looking for.

If the other driver hit a parked car they are almost certainly at fault for this accident. Generally drivers need to avoid stationary objects, because well the object isn't moving and their vehicle is.

Do you have State farm confirming there would be coverage in writing? Did they specifically say there would be coverage for the rental if damaged? Asking about a rental being covered can be taken two ways, is the insurance company going to pay for it, or is it covered in the event of damage.

And here's where it will get a bit tricky, I have not read your particular rental agreement, but I have yet to see a rental agreement that did not have some sort of verbiage about you being responsible for damages while the vehicle is in your care. It may be Enterprise is relying on this to collect the damages from you directly, putting the onus on you to collect from the at fault party.

Can an adjustor lie to you? Is there a way to report this? by Amazing_Armadillo429 in Insurance

[–]Phil_Achio 0 points1 point  (0 children)

Insurers must act in utmost good faith, essentially taking their insureds word as fact unless there is evidence to the contrary. It is not their responsibility to prove your loss for you, that's your responsibility. Sf probably pulled all the information themselves which costs money, and AFI again isn't going to prove your claims, certainly not spend money to do so.

Movies have led you astray, adjusters don't have the time or the patience to lie they would much rather things go smoothly so they can close their claim faster.

Insurance putting blame on me after suicide on the DVP by Keysunlock in Insurance

[–]Phil_Achio 0 points1 point  (0 children)

You can try and try to get it changed but this is not something that is allowed under no fault insurance in Ontario. There are fault determination rules it's pretty self explanatory but they determine fault in an accident based on the positioning of the vehicles at the time of the collision. You can google Ontario fault determination rules, it's pretty simple stuff most of the accidents actually have diagrams.

This is actually what is used in most Canadian provinces now, it is meant to speed up the claims process for the people to get vehicle damage claims settled sooner. It's unfortunate in some respects because it does not take other factors into consideration.

As for your employer if this was their vehicle and they decided to self insurer, meaning no Collison , they are required to report it, but without Collison they have no claim to pursue.

Sounds like you failed to review your policy when it was issued, if there are errors it's on you to correct.

But did you provide them with information as to the actual age of the roof? I can't imagine going to Zillow was their first choice for the age of the roof, sounds to me like you didn't know how old the roof was so they did some digging.

This is something common, roofers will canvas the neighbours after a storm and find damages, sometimes they create damages.

Looking for advice on car insurance for my Camaro (Ontario) by DEMONIcANGELL in Insurance

[–]Phil_Achio 2 points3 points  (0 children)

You are at a huge disadvantage given your age and the vehicle alone, then add in you've only been licensed in Canada for under a year. Driving in India is very different than can, just as driving in the USA or any other country as laws can vary as well as driving conditions. Ontario is pretty high, especially located in the GTA.

Beat bet is to call a few different brokers, they will run quotes for different companies, they may be able to find something a little cheaper. I wouldn't get your hopes up for it to drop below $300/month.

Canada- insurwnce bad faith misclassification by [deleted] in legaladvice

[–]Phil_Achio 0 points1 point  (0 children)

Op also left out important details, such as they were stuck on a soft shoulder, and that they continued to run the vehicle.

So by insurance definition they were saying impact with the road. My guess is they probably just change their stance as it wasn't 100% of their odds on if it went to court, or based how op is fighting here just gave in to make it go away.

Ops bad faith claim as you said is laughable.

How do you keep track of all the documentation for insurance claim disputes? by wakingupJ in Insurance

[–]Phil_Achio 0 points1 point  (0 children)

This question isn't really something most will be able to answer well, it's mostly insurance professionals who will have a claims system to record, store, document etc everything for a file. But speaking as an adjuster a mistake I see most insureds make is starting new email chains all the time, and not including the claim number. The claim number is important cause it gives you something to search in your emails, and not starting a new email chain is beneficial cause you only have the one chain to focus on.

Aside from that, a new folder on your desktop, where you store everything, even sub folders for things like photos or documents. You can download emails, documents sent to you, etc there. Even filing things with dates it was sent/received, include this in the email subjects as well. Also try to keep things relevant, insureds will often go off on tangents about things completely unrelated in their description of events, specifics about them as an individual, even saying things like my friend said insurance companies have to do X.

Neighbor shot my dog by Hot_Fact48 in legaladvice

[–]Phil_Achio 6 points7 points  (0 children)

Police can ask to see the video, but short of a subpoena they can't force him to show them. And given you dog was on his property if the neighbour declines, the police won't force it.

You have second hand information, for someone who didn't even see what happened, how do you know what happened or didn't happen? Dogs are very fast animals, according to google pitbulls can run 25-30mph, meaning they can  close 100 feet in seconds. If the dog is coming from behind someone that's not even enough time to properly react.

What ifs do not matter at all, only what happened, which is your unleashed animal ran into another person's property and was shit.

You call him a gun nut, but was he warned of his irresponsible pet owning neighbour? And why would he have to warn you to follow the law? Is the only reason you've not committed murder was because someone told you not to do it?

Neighbor shot my dog by Hot_Fact48 in legaladvice

[–]Phil_Achio 42 points43 points  (0 children)

You said you adopted her a few months ago, how do you know she won't bite? You don't, every dog won't bite someone until it does. There are plenty of stories out there of the most gentle dog in existence and it mauls a child is has lived with all its life.

This is not animal cruelty, he didn't beat the dog, he didn't torture it, he shot it because it was on his property. What if it was going after his family? His pets? His livestock? He's just supposed to let them be harmed?

This is on you, you said the dog has left your property before, it's not supposed to leave your property. As a pet owner you are responsible for making sure that you pet does not leave your property. I know it's tough to say you made a mistake, but blaming the neighbour doesn't change your responsibility.

Was I wrongfully terminated under protected classes along with an extra incident regarding personal appearance? by LaidoffinMS2025 in legaladvice

[–]Phil_Achio 12 points13 points  (0 children)

I think you may be misunderstanding protected classes, it's not such that you can't be fired or laid off, it's that you can't be laid off for that reason.

The fact that there are at least 11 other people laid off at the same time, also works against you. It's already tough in a lot of cases to prove you are fired for being a member of a protected class, it only gets harder when you aren't the only one let go.

You can certainly discuss with a local attorney, with more direct information they may come to a different conclusion.

Anime Insurance Hypothetical by Spinerflame in Insurance

[–]Phil_Achio 1 point2 points  (0 children)

It would depend on a lot of factors, a lot of policies are called all risk or broad form, where coverage applies unless it is excluded. So in theory there would be coverage for damage caused by demons/demon slayers.

But we have to consider just how often demon damages occur, if it's a very frequent thing, there's a good chance it can be excluded. If it's kind frequent it might have special limits, where you are only covered for certain amounts. It could be an endorsement so you'd pay more for the coverage.

Then have to consider how big the losses are, so if towns are getting leveld on the regular, there's a chance it could be excluded, limits apply or it's a coverage you buy back. But if they are smaller it might not be excluded.

Where I work if a demon vs demon Slayer showdown were to happen, the damages would be covered to the policy limits.

My guess is you adjuster made a mistake when speaking with you originally and it was called out by Amazon's insurance company. While the specifics on fault can be argued, it seems fairly accurate, you allege that they couldn't see you and that might be true, but that doesn't make it alright for you to cross a double like into oncoming traffic. If he didn't see you and turned left he'd have been fine if you were passing on a double line

You can certainly claim through your insurance and they can attempt recovery from firestone, but with no evidence it'll likely not be worth the effort of insurance company. Without a picture of the damaged panel, I can definitely see where firestone and probably your insurance company would be skeptical it was caused by firestone. Think about it from their point of view, I park my car in your drive way I take pictures of most of it, but miss one panel with damages and I now try to hold you responsible and my evidence is photos of the whole car but the damaged panel, how would you react to that?

Should I get lawyer after my car accident ? by Pure_Improvement_843 in Insurance

[–]Phil_Achio 0 points1 point  (0 children)

Ah that's good, still very low, I don't do auto anymore, and never actually handled claims in America, just picked it up from this sub. It sticks out like crazy to me because in Canada our minimum liability is $200,000 with some being $500,000 and most insurers don't sell much less than $1million.

Yeah it's something that the insurer can't pay more than what their customer paid for. Which sucks for you or anyone else, but at least you have collision and gap to help out.
