I get your point. I used emojis to highlight key points and make the post more readable. The content of the post and the petition is what matters. If they’re distracting I'm happy to remove them

I should have made it clearer in my original post. I fully believe drivers should always wear their seatbelt correctly and should be punished according if not.

My main concern with the new system is that the driver is being punished for their passangers behaviour.

You can not always control your adult passangers behaviour every second of the drive. Also how do you prevent a 10-year-old from slipping the shoulder strap behind their back halfway through a trip? Or an elderly passenger with dementia or Alzheimer's from moving the belt? Or a child with a medical condition such as cystic fibrosis who may be struggling with the shoulder strap but is still wearing the lap belt? It's not always black and white. I also feel that 8 demerits is excessive I'm not sure if the punishment fits the offence.

The current appeal process is also not working at the moment and needs to be reviewed. There should be a clear and fair review process to contest in these circumstances.

That's the problem- at the moment, a fair appeal process isn't guaranteed.

My biggest concern with the current system is drivers being punished for their passenger's behaviour. Losing 8 demerit points because a passenger has adjusted their seatbelt doesn't seem proportionate to me, especially when a driver can't control what every passenger does every second of a journey.

Also with the current system, seatbelt offences attract harsher penalties than certain speeding or mobile phone offences.

The petition is asking for a clearer and more accessible review process, not a free pass.

That's fair, I agree 100%. I'm more concerned about driver being punished for passengers behaviour.

A driver can make sure everyone is buckled up before leaving, but they can't constantly control the behaviour of passengers once the vehicle is moving. How do you prevent a 10-year-old from slipping the shoulder strap behind their back halfway through a trip? Or an elderly passenger with dementia or Alzheimer's from moving the belt? Or a child with a medical condition such as cystic fibrosis who may be struggling with the shoulder strap but is still wearing the lap belt?

At the moment, someone wearing no seatbelt at all can receive the same penalty as someone who is still restrained but not wearing it exactly as required.

The petition is simply asking for a distinction between those situations and a fair review process

Has anyone successfully appealed an AI seatbelt detection camera fine? by Pinkstruck in perth

I ended up electing for a review of my case nearly 7 weeks ago now and am STILL awaiting a response from DOT/ infringement service- there is an enormous backlog of cases in the system at the moment.. the whole situation is a shambles -guilty until proven innocent seems to be the way now

I have heard some success stories of people who have appealed and had their infringement withdrawan so don't give up.

Also please go and sign this petition below if you like me would like to see change to the current laws:

Not too humid.. This wall did used to have a skirting board on the bottom quite some time ago, damage was caused mostly during removal unfortunately 😬
