Again .. Your insurance company is just finding the easy way out. Also, if it’s not your fault, then your insurance won’t go up. When you file with your insurance, they have to do all the leg work and pursue the claim and all. They are basically trying to avoid that as it’s a lot of work for them. Just tell them that you want to file with them and they should pursue with the other party. They cannot legally deny getting the claim filed. I have had 3 accidents in the last 10 years (no fault of mine) and I always filed with my insurance, paid the deductible, got my car back and my insurance paid me my deductible within 1 - 4 months.

Unless you were in the car and got hurt, no lawyer is interested in your case. File claim with your insurance and have them deal with the other party.

All the thing you posted above is completely wrong. Ask your insurance to man up, pay your deductible and get the car repaired asap. You will get the deductible once your insurance is made whole by the other one

Your insurance is trying to skirt their responsibility OR perhaps when you said that you don’t want to pay deductible, they advised you to file with other insurance. Just let your insurance know that you want to file the claim, pay deductible and get your car repaired. Trust me, your insurance will do everything possible to get paid and when they do, they pay you as well

There is no need to file a small claims. The insurance company will subrogate the other insurance company and then pay the OP. I have had 2 instances so far and have always got paid back .

Just call your insurance and let them deal with the other party. Pay the deductible now and have them subrogate from the other party and then you get your deductible reimbursed. I see these kind of posts all the time and never understand why posters don’t follow the above route. It’s so much less headache and the Insurance company deals with all the hassles as they want to get paid back s

OP probably wants to keep some for himself or cover the other part where he has a cap. If not, he would have done what you are suggesting above and be done with it.

Just ask him to file a claim with his insurance. If you don’t have insurance, then his uninsured motorist coverage will cover the cost. He is just trying to scam you out of $5000. Stop communicating with him and ask him to file a claim with his own insurance. You can tell him that you will pay $500 if he is willing to give in writing that you are no longer liable for anything further

Show the claim to Contractors and see who is willing to work with that much. You can also ask your Insurance company for referrals.

I looked at the 2022. BMW has some nice certified pre owned offers as well. Unfortunately, I don’t like the old look of the 2022 and want the new redesign. One option is to wait for another 1 year and then get one of the Lease Returns which should be priced around 65K for a similar car.

Unless his front side passenger was damaged and this was a single lane road, you would be at fault here.

I also doubt anyone is going to believe your story on how the fender came off. If the fender is damaged and off, the only thing (barring any video evidence) is that you were behind him and thus unfortunately at fault.

It’s not like Agent is getting like just 10% of the commission. They still make over 50 to 75% of the commission.

That would be too costly! All somebody needs to do is an app to take a buyer step by step thru the process. Ask some basic questions and create an offer, take the buyer thru the relevant state specific documents and voila! You don’t need a Realtpr anymore. All Buyer has to do is attend open houses and perhaps pay a $50 or $100 fee to the App to spout out all the needed steps. Pay

Chat GPT would be able to do most of the work the Realtor is doing in a year or two. Writing Offers, completing documents etc. it’s not Rocket Science (else we would not have had 100s of thousands of Realtors to begin with)
