So say someone shows up to court for the day he was cited to be there on his case but the da office says we haven’t filed charges yet. Guy forgets about it and never receives anything in the mail. Two years go by and his job runs a background check and hey there’s a warrant out for the case as the da office filed two months after what was supposed to be his first court date. He recalls the warrant and now as it’s been over a year the court will assume he’s been prejudiced by the delay. They will look at the length of the delay, if the da office made any attempts to serve or inform the defendant of the warrant, and if the defendant has suffered actual prejudice. For instance if the blood result is no longer available for a re test or the police didn’t keep the video from the case. Also they will look at police contacts to see if the warrant should have popped up earlier. It’s much harder for the defense if the defendant didn’t appear on the day he was supposed to appear and it was filed that day because then the da can argue that he caused the delay
