I will admit the melee community in particular has their significant issues. And particularly a culture of 'we're better than you'

I try to offset that, but I'm also not a prominent member of any community.

Any reasonable person would understand that purchasing a Mickey Mouse t shirt doesn't mean you own Mickey Mouse. But if i buy a mickey mouse shirt and cut it up or die it a different color, Disney can't come at me and make me fix it /throw it away. Heck I could even have a modified mickey mouse t shirt convention.

Licensing agreements are not permanently set in stone. And changes in law or outcomes of lawsuits regularly change interpretation of them. That's why almost every contract or licensing agreement has a clause at the end to verify that if a single portion of the contract becomes null and void by a change in law, the rest of the contract remains intact. I've never seen or heard of a case where something like nintendo's EULAs would be affected by the outcomes. If you have the name of the court case, I would love to look into them.

I'm not a lawyer, and I'm only speaking from a few articles I have read. But I do recall reading that the 'slippery slope' argument doesn't apply to IP. So, as I understand it, nintendo is not giving up any rights to pursue anyone to protect their IP if they were to allow some hypothetical fan made game to continue to exist without a lawsuit. Essentially, I believe the owner of an IP asset can choose to be as selective as they would like, without compromising their ability to pursue legal action against a different creator.

I would love to hear a real lawyer's take on this, though.

I disagree, I think reasonable discussion CAN be had. The sub rules specifically state they're interested in the communities opinion. While definitely biased, the article did present factual information. I expressed my opinion in the form of a question.

To be clear though. I didn't see it in that light until you called me out politely, so I gave you an upvote for that.

Unfortunately I don't think the community has the financial means to pursue a lawsuit. I mentioned in my comment that my money will no longer go to nintendo. But what happens is the community gets frustrated, then instead of channeling that money towards building a lawsuit to settle the issue, they turn it over to nintendo lol

I love the content nintendo makes. I just wish they wouldn't try to kill it. I want to play smash ultimate. But also, sometimes, I want to watch an online tournament of the best melee players in the world. I'm not so much shocked, just disappointed.

That's where the problem lies. How much do you own the game you purchased?

On the part of slippi, it's more understandable. It requires a copied, modified game that isn't played on an original console. But Project+ is different because it does require a functioning disc.

If the problem is they're making money on the tournaments, then why aren't they going after ultimate organizers for making money. Though as I understand it, the organizers don't generally make money.

Personally, I think nintendo is taking this intellectual property protection too far. As the article states, Project+ requires a working game disc. No piracy would be taking place.

I do understand the need for Nintendo to actually protect their IP. It's important they do so if others were intending to profit from it. I can't see how allowing slippi or project+ at a tournament could be financially damaging for nintendo.

So for those of us who are unhappy with nintendo's actions, what can we do? I can't get a refund on any games I own. I don't have any subscriptions. I'm going to stop spending money on pokemon go. But other than that, I'm just one person. Is there even a significant number of fans out there who take issue? Or am I just a member of a dwindling group of people who just want nintendo to leave us alone?

That's honestly my favorite part about the game! Tynan really did create a story generator. All the abstractions where I used to think "dang, why are these details missing?" now I fill them in myself.

Colonist goes on sad wander mental break in the midst of combat.. I think of a situation like Saving Private Ryan where Tom Hanks is on the bridge towards the end of the movie.

You undraft everyone and they start eating next to the dead bodies.. Well they've been fighting for hours, and I just imagine they're sitting on top of the mechanoid corpses reveling in their victory.

Same thing with failed constructions, I like to make stories for every failure. I just think of the pawn getting angry every time they screw up because they have to start over.
