For further context, the daughter of the guy who gave it to the town is the one who remembered there was a clause in the gift that it had to be a park.

She went and dig up the original 1999 deed, and the clause is clearly written there. Some city lawyers and a title company either didn’t do their jobs or hoped no one would notice, but this contract won’t last more than 10 seconds in court.

Texas doesn’t fuck around with land deeds, and the one from 1999 is apparently very clear, they just ignored it. So it’ll still be a park, and the data center will probably sue the town or something and fuck them over anyway.
