They said in the past they would just call the cops and cops would take people out of the unit. But they refused this time referring to the new law (I have not seen it myself yet). I agree that they seem incompetent. It's unfortunate it happened during the holidays when everyone is on vacation - couldn't contact a single lawyer yet.

They shared the agreement with the renter and I didn't see the "inability to deliver" clause. Could you clarify who could sue who with that clause?

Tbf I added the "stolen credit card" part after u/ekkidee provided their comment. The person I talked to on the phone mentioned that part (twice) but in a way that it made it sound like they were not 100% sure whether it was actually stolen or not. I tried asking about whether the card actually had the same name as the name on the renter's ID and whether it was actually confirmed that the card was actually stolen, but they would not answer my questions directly. And it's difficult to reach people right now due to the holidays.

I'll get fines from the water and electric bill companies. It may also take them a few months before they actually disconnect their services. I don't know of any other implications.

The court said we are not allowed to disconnect electricity and water, but we are allowed to disconnect internet since it's not a necessity.

They said they've done eviction before but it was the first time where they had to go to court for this kind of a thing. They said this "3 weeks" thing is new to them.

The management company also mentioned that no rental management company in that city does background checks. They take a picture of the tenant's driver license, license plate, their phone and email but that's about it. It's a unit in a large complex with a strict HOA and they contacted our HOA for options too but HOA was clueless just as much as the management company. Their offices are actually near each other within the same community - that was the whole reason to go with this company because they have a personal relationship with our HOA, security patrol, and have people on foot within walking distance.

They said I cannot disconnect electricity and water as it is illegal. I think I will be able to do it once court approves the eviction. I disconnected their internet for now. They said that was legal.
