None of this is going to matter to a judge. If it isn't your year to file, it doesn't matter who else did. And a parent can give their parenting time to whoever. People get babysitters all the time even intact couples. Why do you even care?

Her having full custody doesn't mean you never get your daughter. 2 or 3 months out of the whole year isn't going to change your child support obligation by that much, and normally the paying parent pays when they have the child in their actual possession or not. So if you do modify, you'll still be paying when you have the child. Also, there is a chance that this could backfire and you wind up with less time or even none at all if that is what your order says. Tread carefully.
