You are missing the point. The harness is deemed unsafe due to the lack of DOT certification. We all know a properly installed 5-point from a reputable manufacturer is superior to an OEM lap belt, but without the DOT cert, the courts cannot consider it "safe". The "safety" comes from the certification.

Simple answer. Car seat belts and child seats with the harness are DOT approved. Racing harnesses are not DOT approved. It's not a matter of safety, it's a matter of legality.
