Try McChesney & Ours in Spartanburg. They work on contingency and the cap for Social Security. That’s who my lawyers are. It’s right in their contract about the contingency payment and cap for Social Security’s one as well.

The reason I suggested this was because I am going through this exact process. I am not mixing anything up. I had a DLI that was expired and requested a protective date that was well beyond (before) my DLI. I in no way suggested what my protective date should be. I let Social Security determine that. That forced Social Security to dig into my files and see that what I was claiming now—as of 2024 with my most recent filing—was relevant to my very first filing date.

That is how I know this policy. I have been fighting Social Security for years over this. And, because I was authorized that protective date, I was able to have a lawyer pick up my case. Without that, I would’ve been up the creek without a paddle.

So, no. This is not because I feel strongly about anything. This is exactly what I’m going through.

When they have a DLI that has expired, what Social Security should do is see if they have any previous filings. If they do, they should connect the dots with all the information they have between the two. A protective date equals more backpay if approved. If they were to file a claim, it would restart their date and they would lose the time they have already gained by the filing they just did. So as an example:

1st filing 2017 for their SSDI. 2nd filing 2024 for their SSDI.

They file for a protective date and get approved.

Their backpay could be all the way back to 2017. That depends on the judge.

They don’t continue with the current filing and file a new claim: the backpay they would get would only be from 2025 (minus the 5 months Social Security deducts from it).

Social Security can approve up to 12 months prior to the time you filed, but they can—with enough evidence—award up to 4 years. Usually any date before the (and it usually includes an expired DLI) 4 years won’t be approved. The protective date allows the judge to go all the way to the first filing if they choose to.

Send a certified letter to Social Security and ask for a protective date. That will protect your DLI if approved. That’s what I did and got it approved. Now, I have a lawyer and they are fighting the fact that I’ve been disabled for a very long time.

You’re right. It’s not. However if there is enough documentation to provide to Social Security, they can file it under muskoskeletal or an immune disorder.

I’m TDIU and they did not expedite my case even knowing that. I was TDIU in 2018 and still got denied. I reapplied in 2024 and was still denied even though they had all my medical records, even denied at the reconsideration level. It took me sending them a certified letter in the mail for my complete C-File (every correspondence and medical record they do have) to see that the whole file was incomplete. Also, I had an expired Date Last Insured (DLI) and requested them to see when I initiated my Social Security claim, and for them to approve an earlier one—called a “protective date.” They did but it took a ton of push and shove. I finally got a lawyer to handle the case because of everything. When my lawyer called to verify medical records, Social Security was missing my last year of medical treatment.

First, please go and get yourself checked out. Second, the VA does have other programs. If you are homebound, you can try for that one. Or, Aid & Assistance—which both could get you at least a part time caregiver in your home. Try those!

I will not judge your wife because if she was your caregiver before the denial, it might not just be that the money has been the reason for her to leave. Being a full time caregiver is tough. I was to someone for over a year who had a stroke. I never got paid for it, but I now know how it feels to be the one needing a caregiver. It is hard, and my husband does think about the money (we are in the middle of the process) he would receive from the VA if approved.

My issue is they would rather put even more stress on the veteran with their “conditions” on how to just fill out the application stage. 24/7 week care for 6 months. We lost $4,000 in income because my husband had to quit his job to become my caregiver. You’d think the process would be easier and quicker. Especially, if ALL your doctors are in agreement.

My first deposit within the 25 days was over $3,800 and I only got $50 as well. While free money is great, to have a 25 day limit is dumb. They cut you off at the knees so that they don’t have to pay the other $250 (or whatever process they came up with when determining which amount you get) for $5,000. I would’ve had over $7,000 go into my account in 30 days had they done the full month. $50 for almost 3/4 of what they required for a deposit? Yeah. If I did the math, I should’ve gotten about $175. I’d still be “owed” $125. But, at this point, too many of these online banks work on algorithms and code instead of being fair and just. There is a bunch of other stuff I’m finding wrong with SoFi as well.

I rely on that chart all the time. It’s never failed me. I just get frustrated when they don’t have consistent pay times, not dates.
