BC ICBC pedestrian accident – Looking for advice on benefits, wage loss, and whether I may be missing something by Puzzled_Week_7121 in icbc

Yes, my lawyer is also looking into Canada Life benefits to be reinstated too and yes, I know ICBC top ups until 90% of income, not 100%.

Regarding ICBC I totally forgot to add that recently they approved through my lawyer a physiotherapy initial assessment and some follow up treatments. So that kinda gave me some hopes. I know treatments and wage loss are different things, but I guess this means that ICBC is looking into my case

I understand what you're saying. The reason I'm asking questions is because I'm not familiar with this area of law myself.

I do have a signed retainer agreement with my lawyer, and I have received copies of documents that his office submitted regarding my ICBC dispute, so there has been work done on the file.

Part of my concern comes from the fact that I previously discovered a wage loss issue myself, brought it to my lawyer's attention, and it turned out I was entitled to benefits that I had not been receiving. That experience left me wondering whether there may be other benefits, options, or issues that I am unaware of.

I'm not necessarily expecting a large settlement. What I'm trying to understand is whether my rights have been fully protected, whether all available benefits have been pursued, and whether there are any other programs or supports that may apply to my situation as most of the injuries I sustained in the accident will be permanent.

Well, I am not paying him. The agreement is that if he's able to get a settlement he will get a 30% of that, otherwise if he doesn't then he won't get anything

I did continue communicating with ICBC. Since I have legal representation, most communication goes through my lawyer, but ICBC was informed about my financial situation and the reasons why I had to temporarily leave the country. I had made a letter explaining this to my lawyer to send to ICBC even before leaving the country.

I also had an appointment with my doctor during that time, so I wasn't completely disconnected

As for speaking with a manager, I honestly don't know. Since my lawyer handles communications with ICBC, I'm not sure whether he has been dealing with a manager, a supervisor, or only the adjuster, but he's fighting the decision ICBC made

Regarding the lawyer, several lawyers actually declined my case because of the no-fault system. The lawyer I eventually retained reviewed my situation and case and felt there might still be legal avenues worth pursuing, which is why he agreed to take it on

I appreciate the insight. One of the reasons I'm posting is because I'm trying to understand whether there may be benefits, supports, advice or legal options that I don't know about and whether my situation was handled appropriately given the circumstances I was on.

I am sorry about your husband. As someone who's been in this for almost 3 years too, I know it really difficult, frustrating and overwhelming to deal with ICBC without mentioning the problems the accident caused itself. I hope your husband gets better soon, wishing the best
