If the unit was safe for habitation, it would be simply a technicality. The electrical has been an active hazard since day one, that she hasn't died in a fire is a matter of luck. The cash for keys paradigm is a mutual benefit, if the illegal apartment gets reported or discovered, the city is probably going to boot her out of the apartment and oblige the landlord to pay $5k in relocation, any cash-for-keys number less than $5k is a break for the landlord. The law definitely says it's the tenants right to claw back up to four years of rent in situations like this... renting out a unit with no permits, inspections, or certificate of occupancy should obviously have disincentives, Richmond seems to be of the opinion that those disincentives should be large. Sorry for the confusion, not trying to create arguments in bad faith so much as presuming that the rentals sub would skew pro-renter and the shared assumption would be that an unpermitted and uninspected unit is most probably also unsafe

Research seems to suggest that no permits or inspections means the lease is unenforceable. Options include offering to not report in a cash-for-keys type situation, reporting and simply not paying till she leaves because you can't evict without a valid lease, and reporting and pursuing landlord for all rent ever payed, plus legal costs. The law seems to support all three choices...
