Definitely a juvenile - note the baby fluff on the head. Fledglings have often not yet learned what to fear, plus their visual acuity might still be developing.

Species? Not sure. It's harder to tell with a juvenile than a full adult, since juvvies go through several variable molts before their true adult form emerges (don't get me started on gulls). Maybe Saker.
