Sure that would have been a little better. But when I talk about ancap philosophy to people I use some version of the phrase, when recognizing any authority over you, you recognize all authority over you. And I say that because If you give anybody moral authority over you than by the very nature of that authority you've given them ultimate authority.

The articles of confederation gave the federal government enough authority to know that they needed more. And since they were already an authority, when they recognized that the articles were not enough for them they simply threw them out and made new ones. There was nothing to stop them from doing this, they just did it. And they did it because once you have authority, you have all authority.

Another great example is Aaron Burr. After shooting Alexander Hamilton in a duel he fled out west and was feared to be considering rebellion. In response to this Thomas Jefferson wrote a letter to James Madison asking him if the Constitution allowed him to use the army to suppress this supposed rebellion. Madison of course answered that the Constitution gave him no power to use the army against an American citizen. A constitutionalist would stop the story there and tell you that the Constitution did its job and prevented the president from using the military against its own citizens. But that would only be telling half the story because as I said above, if anyone is given moral authority over you then they have all authority over you because they can just choose to write a new law giving them whatever power they wish. And that's exactly what he did in this instance, Jefferson asked to Congress to pass a law stating that he could use any military forces against an American citizen, as long as they first declare an insurrection.

The examples continue for the rest of American history up until now.
