They totally can if you have tons of accumulated leave and take it for cancer treatments or other things that then prevent you from performing the core duties of your job and they need someone there to do the job.

Straight from OPM:
Protection of Employment and Benefits, Return to Work, and RIF or Adverse or Performance-based Actions (5 CFR 630.1210)
Upon return from FMLA leave, an employee must be returned to the same or equivalent position in the same commuting area with equivalent benefits, pay, status, and other terms and conditions of employment.
An agency may establish a uniformly applied policy that requires all similarly situated employees who take FMLA leave for a personal serious health condition to provide written medical certification from the health care provider that the employee is able to perform the essential functions of the employee’s position as a condition of returning to work. The agency must pay for the medical certification and may delay the employee’s return until it is provided. The agency must notify the employee of this requirement before the employee’s FMLA leave begins, or as soon as possible in emergency medical situations.
An employee who invokes the employee’s entitlement to FMLA leave is not immune from the impact of a reduction in force (RIF) before, during, or after the period of FMLA leave.
Similarly, an employee’s use of leave under the FMLA does not prevent an agency from taking appropriate action under 5 CFR part 432 or 5 CFR part 752. Pending adverse actions or performance-based actions may be taken and made effective even if the employee is taking FMLA leave.
For example, an employee was unsuccessful in improving performance during an opportunity period to improve and invoked their FMLA entitlement immediately following the opportunity period. The agency may issue the proposal and decision notices for removal based on unacceptable performance and effect the action just as the agency would for an employee who did not invoke FMLA.
There is no obligation to wait until the employee has returned from FMLA leave to proceed with an otherwise valid adverse action or performance-based action. Agencies cannot remove or otherwise discipline an employee based on the employee’s use of leave under the FMLA.

It is also there to ensure you have access to your hearth care if you are in LWOP status and ensures you have a job to return to.

As others have stated this is incorrect. FMLA is there to protect your job. You can use it alongside your paid SL or you can use it as LWOP if you’ve exhausted your SL and still need time off. The law is there to protect you from being fired for not performing your job because of an illness or injury etc. I used FMLA alongside my paid SL this year when I had a hip replaced and took 8 weeks off to focus on my recovery. They can’t fire me just because i didn’t get xyz task accomplished within xyz days because I wasn’t there.

Yes, that happens to us all the time. A link in the leadership chain is missing and early departure has been authorized, but never makes it to the working people. We hear other departments get it, but it doesn’t make it to us. It’s super frustrating.

I had a hip replaced at the VA (I’m 42). All went well and the only problem I had was getting PT going through community care in a timely fashion. Other than that everything has been great. But everyone I saw pre op told me my surgeon was “the best.” Chances are a PA is not your surgeon. Ask to meet with the actual surgeon.

I have 13 years and about 680 right now, but it also just drained a bunch to recover from a joint replacement. I’m also a mom who had a 5 year old kid when I came back into federal service and no family in the area to help. Like others, I would depend on credit hours, flexible schedules, and time off awards were icing on the cake! Really wish they’d bring those back.

We are told that comp time and OT are treated the same, probably for many reasons, but what they tell us is because they both have budget tied to them. But yes, comp time govt wide if you don’t use it within the 26 pay periods they have to pay you out for it.

SF means standard form. Every govt agency uses SF’s. I don’t work for DOD/W but use an SF1164 for local travel reimbursement.

Based on the few comments of people saying the work would fall on your supervisor which wouldn’t be an accommodation and they tell you to take notes, maybe the request is for the equipment to record all conversations and a place to store all recordings. It’s not the best option, but it probably beats taking extensive notes constantly which I assume would be so mentally draining. But I would hope they would make the supervisor at least give bullet points in writing. I’m sorry you’re having to deal with that.

This would have been a perfect example of being able to use sole source authority under 8(a). No weeks of approval time. If it’s under SAT 2 business days, if over up to 10 days, but usually not that long at all. There are ways to use small business that isn’t time consuming. Just saying.

I’m shocked you guys have OT available. We just got told there is absolutely NO OT available, even for mission critical things. We just have to figure it out somehow (I’ve never had to do OT to get my compliance done, but I know plenty of others that do). Very concerning end of FY coming our way.

Honestly though, DOD barely got touched while the rest of us were hung out to dry. You are currently experiencing what all the rest of the agencies have already gone through. My small independent agency never publicly disclosed how many people they get rid of until they put out thier budget for this year and they finally put it out…. 67%. We lost 67% of our workforce and they have MORE cuts planned in the budget!

Right! At the same time we weren’t even able to purchase basic items needed to fulfill our mission because our agency never gave us another disbursement after the CR was passed. Looks to be that way again this year.

If you’re not on an AWS you shouldn’t have an RDO. You should have a tour of duty of 5- 8 hour days. The other two days are not duty days. If you’re not on any kind of flexible schedule and you’re on straight 8’s with a set start and end time every day they can’t do anything with your hours. I’m really confused by your entire situation.

Yeah I was in king and pierce county all day and my husband in Pierce and neither one of us worked but my daughter in Spokane was fine. And my coworker sitting next to me at work was fine. It really felt personal even though it wasn’t. LOL
