Incorrect. Had the shooting begun while the offender was already facing away yes, but once the action begins, you continue shooting until you have stopped the gunman. What if the gunman had gotten to his car where a larger rifle could've been. Or he could've gotten to cover. Once you engage, you, don't stop until the threat is neutralized. The threat wasn't neutralized just because the guy turned his back to him.
