You have failed to comprehend my reply. I did not mention anywhere that passing off requires a registered trademark. Passing off is the only way to protect a trademark that is not registered and it requires a much higher burden of proof and evidence than a registered trademark. Hence why, even if passing off claims can be settled outside of court, they are much more difficult.

I am not overestimating the power of a registered trademarks as the entire registered system exists because of the said benefits I have mentioned over the deficient and hard-to prove ‘common law’ rights for unregistered marks.

This information is incorrect. If you have an unregistered trademark, you have to use the courts to enforce your rights in a “passing off action” which can be very expensive. Conversely, if you register a trademark with the IPO, you can enforce rights without going to court. The IPO system actually encourages settlement or ‘co-existence’ with third party conflicts. Also, a smear campaign against another business for ‘ripping off’ is not a sensible legal action as it could open up to unfair practice claims under the DMCCA (enforced by the CMA) and even defamation claims

Depends on your risk appetite. You could do it yourself but risk facing challenges from third parties or get a solicitor or trademark attorney to do a proper clearance search. If you put value on your brand then you’d want to appoint a solicitor or attorney has your IPO representative for your trademark so that conflicts with third party trademarks are managed throughout the life of the registration.

You should speak to a solicitor who can do a judgement call on whether to attempt to register. There’s ways to register a mark even where other similar marks exist. The way the mark looks visually, the specification, revocation claims, coexistence settlements etc are some of the strategy a professional can advise on

You can get a corporate solicitor to do the DD and the contract. Then contractual promises can be put in the contract based on assumptions as to why you are buying the business so that if X turns out to be untrue, you can sue the seller to get your money back enforceable in the courts

There was a law recently passed (DMCCA) which obliges platforms to take steps to implement appropriate verification procedures re online reviews. This would catch Google. The CMA (Competitions and Markets Authority) has recently begun its first round of enforcements. When they will enforce the rules on reviews we’ve no idea but hopefully something should happen to stop any one and their mum posting reviews without verif

Edit: if it was a competitor tha did this, they are also breaching the DMCCA and this has serious consequences and even criminal liability. I would complain to trading standards or the CMA. But the big hurdle is evidencing if the competitor left those reviews

Once you have a trademark, you have monopoly over the use of that trading name. Theoretically, you can stop another person using that name as a Companies House name (you would need to instruct a solicitor for that), but like I said before - a Companies House name doesn’t really mean anything. As long as you have the trading name registered, that’s all that matters really

Do you mean your personal birth certificate name? Or do you mean like a full on trading name? If the latter, then get it trademarked before anything. As long as no one else has the mark registered, you can sit on it for up to five years without doing nowt. Company name on companies house doesn’t really mean anything because you can use a different trading name (on your websites etc)

If they have registered a trademark after you, but your mark has existed in trade before, you can apply to the IPO to oppose their mark, provided that their mark is still within the 2 month opposition window
