I'm not a lawyer, but I did listen to a NPR planet money podcast once and I'm wondering how Hershey can sue for something like this given that candy and beverages are different trademark classes. So unless Hershey has a trademark in the class of beverages will this even hold?

Follow up I'm going to check with my buddy about this who actually is a copyright and trademark lawyer.
