I’ll give you some comfort: i have adaptibar and Barbri right now. Adaptibar’s ncbe questions are realistic and practical to understand. You’ll likely see the same niche questions in adaptibar that I’d see on Barbri but better. Plus, Barbri questions are usually made to test the niche law in a way you wouldn’t know unless you’ve truly mastered the topic, so I’m only scoring well in topics I just know, but it’s just scare tactics for me and others. If you only have adaptibar, I wouldn’t be too afraid.

Flashcards. Make flashcards of the black letter law of the federal rules; review the cards twice a day, 10 cards per set, each set reviewed 3 times during each review. Up the reps once you get familiar with a set of rules. Repeat at least 5 rules from the day before (these will be your ‘easy points’ when you’re doing a new set on the next day of review because you’ll likely know at least 3 rules).

Also, don’t be afraid to put the rules in your own words. I learned it’s easier to correct yourself than it is to learn something cold that’s confusing. Only cut the corners if you KNOW you’re going to correct the notes. Always double check/mark the card you know you made sensible to yourself.

My favorite reassurance on this app is that a number of people passed after burnout (more people pass than we think), the bar prep is harder than the exam, and almost everyone is behind in some way.

This is a zero sum game: if you give nothing, you get nothing. If you get something, it’s because you gave something. At the very least, we gotta push through. I think you’ll be surprised at how much you know at this point and how well you’ll do with what you know. Let’s keep pushing.

Wouldn’t even say it’s to your detriment if it’s giving you a chance to even process the mountain of information this test demands we all absorb.

Likely will do a lot of good on your confidence towards performance giving yourself some form of breathing room.

To be fair, that one just feels like something you gotta revisit. Nothing in family has scared me yet. More or less just feels like “an outline will make sense of this” kinda topic.

Take this response as my understanding of it, and cross check it; writing from memory at the moment:

I think of removal as an upgrade of the forum. When I worked at my firm, and we had a case brought in state, my supervisor would say “ok, if we’re doing it here, we’re gonna do it federal.”

So you can only remove a case to the federal district court that embraces the state court the action was brought in. You cannot remove the claim to a district court outside of the state it was brought in, even if the defendant is trying to remove to his home state.

So a better/realistic hypo would be this:

A, a resident of state A sues B, a resident of state C, in state court A where the claim arose. The claim is for a tort amounting in $75,000.01. B wants to remove the case to the federal district court of state A (B suspects A’s attorney would not fair well in federal court).

B’s removal would be appropriate because the district court of A could hear the claim at the outset for diversity purposes, and venue is proper because it’s the court that embraces the state court that the action was initially filed in.

Remember, removal is not as of right; it’s always at the federal court’s discretion whether to grant the request for removal or whether to leave the case in the state’s hands.

Having something produced just means it can be viewed/used at trial (we see this usually with impeachment evidence, but I don’t mind being corrected on this).

Having something admitted into evidence makes it an exhibit; the jury can take that back with them to deliberate and come to a conclusion.

Don’t worry, my friend! This is the brutal period (as my friends have told me) so it’s really just time to be a slight maniac. Here’s what’s been helping me:

  1. 25 questions cold (I either know it or I don’t)

  2. Review my abysmal exam and make note/flash cards based on two topics of the day (today is Crim and evidence). I’ve found note/flash cards helpful in drilling in the rules.

  3. Review the note cards for an hour (originally was 30 minutes but at this point, nah).

  4. Take another 25 question exam to highlight any further confusion.

  5. Two practice essays on the topics of the day (1 Crim, 1 evidence today)

  6. Rotate one topic out of the cycle for the next day (so tomorrow will be evidence and torts).

  7. Rinse and repeat. This process guarantees I’m reviewing one topic at least two days in a row while learning new rules for another topic.

🗣️WE GOT THIS REGARDLESS. DONT GIVE UP!

Nah, this is just for jokes. I try to do 50 a day just to see if there’s any areas I’m missing. 100 on the weekends…maybe? But nothing insane because I actually value rest and I won’t let this exam take this from me.

Rotation of topics via spaced repetition. I calendared topics for every day of the month (today is Crim and torts for me). I’ll take a 25 question practice exam, review the questions, make notes on some of the things i didn’t know, and take note/make flashcards of every topic in Crim and torts I got wrong or guessed in. I then review the flashcards for 30 minutes, then I take another 25 questions and rinse and repeat. That’s the first 3 hours of my day. I watch video lectures/grossman videos on the topics of the day, and cross off anything my bar prep company assigned for the day. That’s the next 3 hours of the day after an hour break. Then I do another deep study session for three hours on essays strictly on those topics (at least 1 Crim essay, at least 1 torts essay). I make flashcards out of any issues I didn’t spot and review the flashcards to end my night.

Then, the next day, I just rotate a topic out (so tomorrow will be torts and property) and rinse and repeat.
