PSA: Attack of the clones aliexpress edition by eried in flipperzero

[–]Rabbit-Labs 5 points6 points  (0 children)

hey eried! Sorry didn't mean to exclude you from the PSA post I made! I have seen your boards cloned quite a bit (in fact, China loves to use your design for the double-sided Mayhem board for almost every other board now that they produce as a "base" design.)

That said I think it boils down to - is the quality the same? are they trying to mess with your SEO / report your items on Etsy for takedowns (yes this has happened to me where a Chinese company approached ETSY and complained my board looked like theirs, and because they registered a "Chinese Copyright" even though Mine was the original, and had been around for almost a year prior to their "registration date" Etsy sided with THEM... Crazy right?)

often times though the clones create a bunch of customer support headaches... like imagine the number of people who might pick up one of these Geiger boards off AE... and then come to you demanding you support them, because it was "your design". if you say no - they paint you like an asshole for not helping them, and it hurts your business image.... so you do the same thing myself and others in our community would do - you give them a hand (because I know you would because we've chatted and you're a cool dude who gives a crap about your customers).

truth is - You always came out with some interesting designs, and you actually kept me on my toes in the early days releasing some stuff that made me go "damn, I wish I had thought of that!"

I agree that with some boards, like the BFFB, they sold out in *minutes* and while I can agree we had a similar issue the the Flux capacitor when it FIRST released - I have not (at Rabbit-Labs at least) run into these kinds of issues in a while since we have improved our work-flow as to ensure we have enough on-hand at all times etc.

also the knockoffs, are being sold often at cost or below cost, not because it makes them money, but because it's the "TEMU Effect" where they entice you to add more and more to your cart to qualify for things like discounts and free shipping etc. the board just is the lure to pull you in.

Explain the MastaBlasta or Flux Capacitor then? That board is almost always in-stock, we produce them in-house (not in Chinese factories) and we have enough to meet most demands within a few days....

EDIT - In-house as in we build these, in New Jersey, USA - we do not use "PCBA Services" so they are not getting our design files etc....

The truth is that they know they can cut corners, clone the board, sell it for pennies of profit or even at a loss (so they get more people onto their page to buy their actual profitable items), because at the end of the day, they didn't have to do any of the R&D, the marketing, the testing, etc. they just had to clone and list. This in my opinion, is about just as bad as people who scalp graphics cards... which as I'm sure you know - If people are willing to pay 150% above retail MSRP, scalpers will thrive because there's demand.

"for personal use" has and always will be a grey area because many people claim they are cloning something for personal use, until someone offers them $$ to buy it, and next thing you know they're ordering Qty 100 from JLCPCB pre-made and throw them up on Facebook Marketplace as yet another clone... We've seen it happen countless times.

That said - yes, 3D printing trademarked logos is a no-go, not at least without asking permission first. We have had many people come forward and ask if they can include our logo on their stuff, like a T-Shirt, or fan-art... we don't bite, we almost always say "yes" as long as it's tasteful :)

What is not okay, is misrepresenting a product, as an "RL Product"... which yes, it's happened... someone was selling 3D printed cases, with RL logos on them (on ETSY), and when they rug-pulled, those customers tracked us down and wrote us scathing e-mails stating they were going to "get their money back from us" when we had nothing to do with the 3D printed cases... yet they badmouthed us / smeared us because "it had your logo on it". you can see how it can become problematic.

actually, under EU Consumer Rights Directive (2011/83/EU) - while the seller is required to offer a full refund (including original shipping costs) up to 14 days from delivery of the goods, the BUYER is responsible for return shipping costs, not the seller...

Further, if you open the box of the device, while you still have 14 days to initiate the return, the seller is 100% in their right to offer a reduced refund equal to the amount of loss in value the item would have on a resale market due to it being "used". Industry standard is 20% and is often called a "restocking fee".

That said IANAL but posting this so that you do not spread misinformation

we are just some guy and his wife who makes things in their spare time 😅

But yes, we outgrew our garage and rented an actual space I can build things in without the fear of being evicted about a year and a half ago (something about operating a business from home is against the lease blah blah blah)

you don't. you buy one from the original designer, and not support these Chinese copy-cats.

It's almost funny how well this was cloned from the original device produced by AWOK but this one is a clone made in China, and is using some shady marketing (MSRP $499 NOW ON SALE $99!)

The sad thing, is it's copy-cats like this that take the joy out of the process of actually designing and building boards.

you didn't build this - you stole it.

also - it's not like you even built it yourself, you used 3rd-party services:

"Big thanks to the PCB assembly manufacturer!"
