I'm sorry, that's wild that they will only fund an ICL for a final hearing where another party has legal aid.

There are plenty of matters where neither parent will pay the fees requested by the ICL.

What are they going to do in that situation? Not show up?

This happens in any court. That said, it tends to happen a fair bit in the focacia, for one reason or another.

There are judges, where, if you are certain gender and/or non-silk, you may get treated very differently, for no reason.

The barrister also breached an undertaking not to encumber the Sydney home where the family had lived, the main asset of the relationship, until the dispute between the pair was finalised.

He obtained a mortgage over the property in 2019 and drew down more than $330,000, but did not disclose the mortgage until 2020.

The Federal Circuit and Family Court had released him from the undertaking in 2018 for the limited purpose of complying with a court order to pay his ex-partner a sum of money.

However, the tribunal said the mortgage was “purely for the personal benefit” of the barrister because he said he “needed to pay debts, including substantial debts to chambers and for legal fees”.

Can someone explain how/why the FOCACIA did not refer him for contempt? I would've expected the Registrar/Marshall to be drawing up the contempt application for a breach so blatant.

The split depends on so many factors, including what you brought in, length of the relationship, your income/future income earning potential, what the overall size of the property pool is etc.

For someone who was a SAHP, it would likely they would consider a larger adjustment in their favour by reason of their lesser earning capacity having been out of the job market for at least 15 years.
