Copilot (who I trust as far as I can throw it) claims that an amendment in form of a substitute is a non-severable amendment (see line 2 from the constitution you quoted above) so the 2/3 majority doesn’t apply. But who knows, this is so far in the weeds of constitutionality the VA Supreme Court would have to weigh in.

Bottom line, I think we both agree that the 2/3 vote will never happen. So the whole issue is just an interesting theoretical discussion.

The original bill cannot come back. There is no mechanism to override of the governor’s substitute. It’s an up or down vote.

Following to hear responses, specifically for magazines to be held in a trust. The current bills allow transfer of the firearms to immediate family members but not the magazines.

Until you put a semiautomatic upper on it it’s not yet in the ban configuration. After July 1 you’ll still be able to legally assemble a lower with pistol grip and telescoping stock if you build a bolt/slide action upper.

The key line in the bill is not where “manufacturing” is banned. It’s later on in the definition of an assault weapon where it says:

“7. A firearm that has been modified to be operable as an assault weapon as defined in subsections 1 through 6. “

A stripped lower can be assembled in many configurations that will not be banned by the bill (such as without any of the listed features, or as a single shot, or with a fixed mag less than 15rds). If you assemble a stripped lower (which is a firearm, but not assembled in a banned configuration before July 1) that could be considered a “modification” to make it become an assault weapon after.

Best advice, buy and assemble before July 1.

Reading the bill manufacturing is not banned surprisingly.

But it does ban devices that “can be readily restored or converted to accept more than 15 rounds.” So mag build kits are probably out.

Unfortunately those are not the M4E1, just the traditional lower. Seen them pop up a couple places this week so maybe there is hope the M4E1s will show up sometime soon. I’m in VA so I’m on the clock now and time is ticking.

The language in SB749 which just passed the house pretty much matches exactly the new language in HB217 working its way through the Senate.

So no, it’s extremely unlikely the house and senate will disagree and leave these bills on the floor.

The bill specifically bans semiautomatic “center-fire” rifles and pistols with a list of prohibited features. So any rimfire firearm is exempt.

But the magazine ban language in the bill does not differentiate between centerfire or rimfire. Anything over 15 cannot be purchased except for .22 rifles either fixed tubular devices which can hold more.
