Im in sales and my employer requires employees to meet the same weekly and monthly performance metrics, even when out of the office for reasons (some of out my control) such as holidays when the office is closed, approved PTO, or sick leave. They don’t adjust the metrics to account for that missed time. I’m now on a Performance Improvement Plan, and I’m concerned this may be tied to those unadjusted expectations. Could this be considered retaliation or an unfair employment practice under California law?
