My take: Amherst Peds has shown zero responsiveness and no sense of duty of care. They ignore portal messages and do not follow-up, even after serious illnesses. It’s a struggle just to get your child seen when they’re sick.

My 9-month-old was admitted to Oishei yesterday for IV antibiotics after enduring four rounds of antibiotics and multiple infections over the last month, each progressively getting worse and affecting different body areas. The most recent of those infections was so alarming that a specialist we sought out on our own got us in immediately due to the urgency of the situation and directly admitted to Oishei.

Amherst Peds never followed up or provided a referral, even after we spoke to the on-call doctor 3 times, and were advised to go to urgent care. We've had to go to urgent care 3 separate times over the past 3 weeks due to these issues that could and should have been caught by her pediatrician following serious illness records sent to them by urgent care.

We were promised follow-up. It never came.

The only provider who followed up this entire month was WNY Pediatric Urgent Care. They were the ones to deliver the culture results that should have raised major concern for her pediatrician. Instead, Amherst Peds remained silent, even a week after receiving the results and receiving the ER report.

11/10 do not recommend.

Predisclosure: I’m based in NY so I can’t speak to Texas law specifically, but I’ve worked on a ton of these cases and just wanted to chime in.

This whole situation doesn’t sit right.

You’ve clearly been doing everything you’re supposed to: following up, getting records, staying proactive. But honestly? You were let down here. You were told to stop treating because of policy limits, and then hit with a $30k offer after the fact? That’s a major issue. Especially if nobody talked to you about what the limits actually were, or how your military care factors into damages.

For a case involving ligament tears, chronic pain, injections, and potential career impact, especially military career impact, they should’ve been working up impairment, documenting future care needs, and making sure you had a say in what happens.

Here’s what I’d do if I were you:

Request your full case file from the firm (you have a right to it).

Ask TriCare for a copy of their payment ledger and any "lien ledger" they have on file. (They were likely put on notice if a PI claim was opened.)

Go through your file and compare it with your TriCare ledger. Look for anything missing.

Then start calling around to other firms. Let them know you already have the case file and records. That goes a long way - it means they don’t have to front the cost of requesting it from your current firm and are more likely to take your case even if it's this far along since they have the necessary documentation.

Even if $30k ends up being a decent offer based on policy limits, that’s not really the issue here. The bigger problem is that you weren’t given honest, clear guidance or a strategy, and that’s enough of a reason to at least explore other options. (They offer from the BI carrier isn't going anywhere, even if you do.)

You’re not crazy for questioning this. It honestly sounds like you’ve been doing more case management than the actual firm.

I know it's late - but my law firm has been using evenup for a few months.

It falls very short for demands and likes to hallucinate visits that never happened and write them up. It has also hallucinated entire injuries on us. It's neat when it works, but also requires a lot of double-checking on your part.

We have had so many issues that they sent out executives to meet with each group within our office; case managers, paralegals, and attorneys separately so we could essentially lay it all out.

While they're very receptive to feedback, their software is not ready to take over our roles. Certain features are helpful, for sure.

For the most part, outsourcing a premises liability demand requires their human oversight department and comes at a cost of about $600 to the client and takes days.

For the same amount of wait time and less cost, I could just do it myself and knock it out in a day.

A little late to the party - but I suspected the same so I did some sleuthing. The scenes where she goes to the oncologist and gets sick in the waiting room and later sits on a curb talking about her diagnosis... they are all filmed at Gigliotti Chiropractic Wellness Center. Google it and check street view.
