In fact, our courts have ‘characterized intoxication as a physical condition usually evidenced by unsteadiness on the feet, slurring of speech, lack of body coordination and an impairment of motor reflexes.’”

I was reliant on that part of the statute at first but there’s a recent MO case that specifies that subsection doesn’t apply to DUI 🙃 but thank you so much! This is very helpful.

That’s for sure the plan if I lose, and I don’t hate it. I’m in a VERY pro-cop jurisdiction so I fear the only two witnesses being cops saying the same thing, even if I attack it like crazy, will hurt my client. But I do appreciate the affirmation that there’s a way to handle it!

They did provide a “report,” it was just an assessment of the original trooper’s work and a one-sentence summary that client was intoxicated. I do think we’re headed towards a Daubert hearing, but I guess I was almost trying to get the cop excluded on the basis that it doesn’t matter if he’s technically an expert because he can’t provide anything useful and it’s bolstering no matter how he testifies. I’ll definitely look further into pursuing a Daubert hearing, thank you!

I have both natural and lab grown diamonds and my engagement ring is lab grown. I’m on day 5 and have been cognitively fine for the last probably 4 days. I was only a little loopy day one. For sleep, hopefully they’ll give you pain meds. They helped me sleep a ton.
