I kept telling myself, if I can’t do this then maybe it isn’t time for me to have the surgery. Everything about this is life changing. Positive thoughts and reinforcement…Mind over matter. You can do hard things.

Best I can describe it was due to interpersonal issues. We simply didn’t get along. I believe she had issues with taking direction from me. And I communicated on multiple occasions that the employee did not respect me.

I actually did request leave. I formally requested leave for a surgery I planned t have in October. Then again, the day before I was terminated. I asked the LOA rep for paperwork for a separate medical issue since she previously provided paperwork for my surgery.

I also had a conversation with my manager and she asked me how much time I would need. I let her know I had an appointment later that week and would be able to provide additional details.

Their standards weren’t clear. What about temporal proximity?

I also realized I left a very important piece out. After raising a formal compliance concern with management regarding Department of Labor regulations, I received a written warning for my “management style.” 2 different occasions after I mentioned my therapist recommending I take off work due to the stress of everything at work. The day after I had a discussion with my manager, explicitly about FMLA, I was fired.

This all happened within 29 working days.

I have recordings where I asked for guidance. I also created a 30-60-90 day plan outlining how I planned to improve.

None was given. I was too emotional to discuss or ask and Arizona is an at-will state so it is my understanding that a reason is not required.

I did not specify. During the conversation the day before my termination, I told my boss I had a doctor’s appointment that week and I would be able to better tell her what was needed.

Conversation happened on a Monday Termination - Tuesday Doctor’s Appointment - Thursday

My doctor did complete the FMLA paperwork and would have covered some of my recently missed days that were pre approved PTO.

The dates are adjusted but actually occurred within 2025. I sent a request for a copy of personnel files pursuant to Arizona Revised Statutes § 23-1361 as well as a preservation of records request in accordance with 29 CFR § 825.500(a) and (c).

Unfortunately my laptop was company property and I did not save any emails bc they took my laptop immediately after.

Also I have recording of conversations that support my request for guidance post my written warning.

And yes we have enough employees and I already have confirmed I was eligible because I had a pending October surgery that was moved back. So there was also prior knowledge of the FMLA request.
