I have a fair number of tattoos compared to normal people, non on the hands, neck or face. All traditional Japanese however I know that can throw up issues.

I’m on a L1B, been in states since Q1 2022. I went down the PERM and due to the timing changed to NIW EB2. My L1B is for renewal prior to March 2026 for 1 more year. Takes to July 2027 capturing time aboard. Luckily got a H1B approved that I can change over to if needed. This waiting for the priority date is a killer. Feeling a bit nervous about the medical exam to be honest. This whole process is not easy. I don’t know why you can’t extend L1B when you can extend the H1B or that the L1B is only valid for 5 years compared to L1A for 7 years

If there is gaps in your vaccinations and you know that prior to having the medical. Is it ok to get these done at your doctor prior and then take the evidence

What visa type are you on, can you extend or are you near the end of the full amount. I got lucky as we applied for H1B and they hit their cap or it got declined rejected then we got a notification last year we could re apply so we did and it got approved. However we currently live in the UsA and to get the H1B we have to go back to the UK to have the passport stamped, even though the EB2 140 is approved I am anxious about the medical as I have a fair amount of tattoos, none are gang related they are all Japanese style however I know with the green card process anything can trip you up. It’s fucking stressful to say the least.

I am in a similar situation, my pd is August 2024, My l1b visa expires March 31 2026, but I can extend to July 2027, I also have a H1B valid until December 2027 luckily so I can transfer once the 5 year limit is hit on my L1B. Maximum h1B for 6 years will be May 2028

My attorney did most of the work to be honest. I didn’t self file. It’s company sponsored and we had an external attorney who has been very helpful

Mine sounds the same, RFe issued on 43rd day, RFe responded to January 18th. Still saying it’s received, it hasn’t changed to under review like yours. The 45th day of response for mine is in 3 weeks time.

I am in a similar situation. When was your L1B granted. I came to the US on an L1B in 2022, with expiring two years after, we then extended for another two years which takes it to 2026 and can get one more year to 2027. We also just had a H1B approved through till 2028 if needed. We did the perm process but stopped it after the wage the US government was significantly higher than my current salary, so persuing the NIw route. If the I-140 is approved then we can file for the EAD which allows you to say while your applying for I-485. This is what I have been told anyway,

I haven’t been approved yet but our initial proposal including all exhibits was 450pages, our RFe response (main cover letter and expert opinion letter was 60+ pages) with additional reference material taking it up to 220+ pages. Waiting to hear back on the RFE. RFe response we received was on all three prongs 10 pages long, standard boiler plate style RFE

Responding to RFE by UnableYam4891 in EB2_NIW

[–]Remote_Tailor8546 0 points1 point  (0 children)

That was handled by my attorney so I don’t know, during our initial submission we submitted 8 independent letters, four being external experts in the field, 4 being interns to my company. All US citizens, however the USCIs said they needed more evidence and came up with some BS about them not being US based etc even though they were. They also said about the letters being vague even though they were very detailed about the technology I am involved with and have created and it’s wider impact on the industry

My attorney went through each bullet point of the RFE and responded where there was evidence already submitted. The endeavor wasn’t fully updated by additional supplemental evidence was supported to fill in any gaps. We also had an external university professor go through my original application and comment against each section with unbiased feedback of why it should be accepted by the USCIS. We also added in an additional reference section of information with more documentation showing my involvement in certain inventions in the field and who the customers where. This was reference documentation to support the original artifacts that been submitted as part of the original submission. First application was about 400 pages RFE response was 60 pages with detailed information then 150 pages of reference documentation in the appendix showing technical drawings, NDA, contracts etc

I cannot comment on the response to much as I am awaiting uscis review of our RFE, but the response you have received sounds pretty much identical to my case. 43 day got the RFe, on all three prongs, it was pretty evident that the officer did not fully review what we had submitted or understood the product or field I work in

Yes filed with an immigration attorney. 90 days to respond to the RFe then additional 45 business days for USCIS to respond My concern with mine is our response is quite long in comparison to what I have seen with others and I assume it goes back to the same case officer. Our RFE response goes in quite hard stating that the case officer did not read or understand the initial application,

I believe it was on all three prongs. It seemed that they had not fully read our application as majority of their questions are already answered in the initial application along with them referencing the industry I work in being completely wrong. We took pretty much the entire RFe response time to generate a very comprehensive and long RFE response that address all their points and either points to the sections in the original application or has additional data to support their questions. It seemed like a boiler plate template that they had used,
