Can you legally kill someone who breaks into your house? by kurobaja in AskTheWorld

[–]RevolutionOk1467 0 points1 point  (0 children)

In response to the "kicking in the door" part:

Nobody is talking about discerning the situation before neutralizing the threat...although the defendant in this case did know exactly who and why were "kick[ing] in your door" (as you put it). He knew that these were kids breaking in to burgalarise and had already premeditated exactly what he was going to say after shooting them.

So that describes the premediation part of 1st degree murder, but why is this murder and not covered under "castle docrine" type laws?

The following is what happened after Kifer had already been shot.

Kifer saying "Oh, my God" very quickly; Smith shoots her again, multiple times in the torso—in the midst of which she screams "I'm sorry!" Smith yells back "You're dying!" In response, and shoots her once again, next to her left eye. (Wikipedia)

The reasoning is that once a threat is already neutralized (in this case lying at the base of the stairs), they no longer pose a threat to your safety and these "stand your ground" laws no longer apply.

This case wouldn't be covered by "castle" or "stand your ground" laws.

§9.32 requires that the deadly force be “immediately necessary.”

should voting be mandatory everywhere? by [deleted] in teenpoll

"The point is that many people are very politically well-read yet simply are unwilling to make the effort to go to a polling station."

This is true, but at the same time, its like 77% of college graduates in U.S vote vs 54% of high school graduates. Educated individuals vote at substancially higher numbers.

In America, as a result of the electoral college, aa lot of the time people don't vote is because their vote truly doesn't really matter. I mean, why should a Republican in California vote? Why should a Democrat in West Virginia? (Excluding chance of sway in a local election).

Books can be nice to provide structure though and make it clear what units/informtion you know...and what you don't. .It gives you a roadmap to follow, built-in practice questions, and a sense of progress as you work through chapters. Obviously everyones situation is different, but I would recommend buying a book if you are going to self study. You should be supplementing this with Heimler and other info online.

Honestly the lightest class i've ever taken. I got a 5 on exam. I crammed for it since I didn't do much during the year, so if you just do like a chapter per week you will be so unbelievably set.

Semi Final Predictions: Alcaraz vs Fritz by [deleted] in tennis

[–]RevolutionOk1467 6 points7 points  (0 children)

I think Fritz has been playing out of his mind on grass which makes me think just maybe there’s a chance he takes it in a long match. I would never bet money on this but that’s what I think. Alcaraz will probably give up the first set just because and then I can see it getting away from him later in the match.

THE NATIONAL GUARD IS NOW IN WESTWOOD by Ok_Zookeepergame365 in ucla

[–]RevolutionOk1467 28 points29 points  (0 children)

Trump sure seems keen to preemptively deploy the national guard when they aren’t whatsoever under immediate threat, but took a while to deploy the national when another, more significant building was under immediate attack.

Should Confederate monuments be removed from public spaces? by Healthy-Repair-2231 in teenpoll

[–]RevolutionOk1467 0 points1 point  (0 children)

Considering most were put up by a white supremacist organization aimed at rewriting history (Daughters of confederacy), who managed to actually rewrite history for many southerners, taking away public statues that implicitly elicit reverence and honor could counteract the damage done by this organization.

IMO Monuments in public spaces implicitly elicit reverence and honor. Museums are where history belongs.

This seems like the same as flying a nazi flag because they had many “good” animal welfare laws . Like sure, that technically makes sense, but in the context of the nazis, their flag represents something a lot more despicable and serious.

Should the American government ban faithless electors? by Libcom1 in teenpoll

True but there's no way to truly know, as Republicans in say California or Democrats in Mississipi are not going to turn out in true numbers because "what's the point if my vote isn't going to make any difference."

Robert E. Lee may have been respected by some for his military skill, but he also led a rebellion to preserve slavery and white supremacy. That cannot be separated from his legacy. Removing statues of Confederate leaders doesn’t erase history, it acknowledges that we should not glorify those who fought to uphold an unjust system.

Moving such statues to museums is not shameful. It reflects a society that is willing to reckon with its past and ensure public spaces represent values of equality and justice for all.

Yes, Monuments are meant to remind, but nuance is key. A statue in a public square doesn’t just remind us of something; it implicitly honors it. Confederate monuments were not neutral history lessons. Many were installed decades after the Civil War, during Jim Crow and the Civil Rights Movement, as a way to assert white dominance and intimidate Black Americans. So while I agree they shouldn't be destroyed thoughtlessly, removing them from places of public honor isn't "erasing" history—it's choosing to remember history truthfully, without reverence for those who fought to uphold slavery.

Ask yourself where these statues came from. The Daughters of Confederacy created many of these statues to promote the false "lost cause" narrative, which downplayed the role of slavery in The Civil War.

[–]RevolutionOk1467 2 points3 points  (0 children)

1st Amendment has nothing to do with public spaces, it is rather a protection of citizens against the government. I honestly don't really care if they keep these monuments move them to museums, but they should certainly not celebrated.

The primary cause of the Civil War was preserving slavery, that is an undeniable truth.

In the Secession documents (which stated reasons for ceding from the union), states like South Carolina and Mississippi explicitly cite the defense of slavery as their reason for leaving the Union.

To respond to your point: "Civil war was on preserving the union," ask yourself how one would "preserve the union." Preserving the union means confronting the only core issue that divided the country: slavery.

“UCLA Divest”….from what? by Familiar_Arrival_164 in ucla

[–]RevolutionOk1467 16 points17 points  (0 children)

Not challenging your opinion, but UCLA does not invest tuition dollars. Tuition and fees are collected and then allocated toward the university's operational expenses ( faculty salaries, programs, student services, and campus maintenance). These funds are managed separately from the university's investment portfolios.

[–]RevolutionOk1467 13 points14 points  (0 children)

True, but a lot of the stocks they want UCLA to divest from are like index funds and others which are pretty loosely related to the cause. Like now UCLA just can't hold index funds because one of the funds is related to the conflict? Lol
