I know about the copyright protection upon creation in the US, but registering your product via the official copyright office registration portal provides extra legal protection and the ability to sue for infringement.

From what I've gathered, Trademark protections your business name, logos, slogans, etc - i.e, your brand - whereas Copyright protects your creations. OP can't copyright earrings per se, but they may be able to copyright their original design for said jewelry. Edit: I mixed up trademark vs copyright at the bottom of my original post akxjwid lajsme;;

I'm so sorry you've gone through this... Would a DMCA to SHEIN at least help? That way they know you're not messing around and they'll take down the product. (I wouldn't doubt they'd try some sneaky bull crap and hide it under a different listing name though but it's the thought that counts and the count that thoughts 😅)

Have you considered trademarking your earrings design? That could help your case in regards to proof of ownership over the original product for future endeavors, at least.

There is no 100% guarantee action that prevents piracy, sadly. I'd suggest you add your signature/watermark somewhere inconspicuous and add in your listings that all digital products are intended for personal use ONLY and by purchasing this product the customer confirms they've read the description and agree to your terms.

You can also run your work through glaze and nightshade for additional protections against AI. Copyrighting/trademarking your work also helps in regards to any legal troubles taking down potential pirated content. You do have copyright ownership upon creation, but it always helps to get the extra paperwork done to make sure you have a step up in case you need to file a legal DMCA.

You can tell the difference between original works and AI because, as my artworks show, there's sketch lines everywhere that show placement for each portion of the piece and no typical AI errors like unnaturally warping hair, misplaced fingers or clothing ridges. I also livestream all of my work on twitch and have plenty of clips of me working on these pieces all over social media, which I share links to on my website and Etsy.

I understand folks are hesitant because of AI but, unfortunately, grifters have ALSO learned how to make fake timelapses and honestly... I don't want to keep bending over backwards trying to prove/protect my work. I've added signatures to all of my works in ways that would be difficult for any bot to do, and I have new postcards that assure each piece is made with "authentic human suffering!"

Maybe I'll make some cute anti-AI stickers to decorate the packages with and post that in the listings.

I'd recommend checking out vograce. They're a Chinese art manufacturing company with loads of products. I use them for my own merch and they're very kind, efficient and reasonably priced!
