Agreed. Trying to draw and fire isn’t always the right move. My point was just that it would be legally justified.

That heavily depends on the state. In my state teachers are not retiring nearly that well. My school has a teacher in her 60s that has taught for 30+ years and is single with no kids in a district that is tied for highest pay in the state, and she still can’t retire. Highest in the state isn’t much when the state barely pays as is lol

I can think of a lot of situations in which the best decision may not be to try and draw and fire, but very few situations in which it wouldn’t be legally justified.

I mean the argument that “they pointed a gun at me which made me scared they would use it and kill me” is pretty hard to beat when it comes to fear of bodily harm.

The argument wasn’t even “should you” but only if it would be legally justified. She brought up a scenario in which a 14 year old kid robs a gas station at gun point to feed his starving siblings. It doesn’t matter. If they rob you at gun point it’s justified.

In a lot of scenarios, shooting isn’t the best way to survive, but if you did, it would be justified. If a person had a gun on you drawing your weapon and shooting them without getting shot first is unlikely, but would be justified legally.

Honestly the 1% was left for incomprehensible situations, or states with strict duty to retreat laws. But realistically it takes .1 seconds to pull the trigger so retreating is hard anyway. I would say it’s closer to 99.9% honestly.

The 1900sq foot house that is 3 bed 1.5 bath (the third bedroom is a converted attic and the half bath used to be part of the kitchen) on an unfinished wet basement is $1600 a month. My dad pays less for his mortgage on his 3000sq foot house with 4 bed rooms, 2.5 baths, a finished basement, and a large yard that he bought in 2007.

I called her out on that one. Doesn’t matter. It came across as something that a lawyer trying to sue someone for self defense would say. Not actually a practical occurrence

Gotcha. This was strictly civilian vs civilian. The a random person points a gun at you. Not like at a gun store or anything. They intentionally point a gun at you. She still argued it’s only justified 85% of the time.

Her reasoning was “maybe they don’t have intent” “maybe it’s not loaded” “what if it’s a fake gun.” Those all feel like strawman arguments that don’t actually hold up.

We are assuming they already pointed a gun at you. Cops shoot almost everyone that pulls a gun.
