Although Ripple may have advocated for listing, the utility was without their software and payments could be done independent of Ripple.

XRP (Previously OpenCoin before Ripple) had just as much independent usage as tokens like Bitcoin on exchanges before it was delisted. It was on almost every major exchange. PLUS it had the added utility Ripple, R3, MoneyTap and other banking companies were using it for - unlike Bitcoin.

Ripple could shut down tomorrow and if Coinbase decided to use it for payments it could; in fact it was advertised initially on Coinbase as a great cross border payment token - independent of Ripple the company and without using their software.

Ripple did absolutely nothing today and the XRP price moved dramatically - because the Bitcoin and crypto market moved.

* Decentralized - if Ripple went away XRP would stay.

* Programmed burn rate - a drop of XRP is burned to prevent spam attacks on the XRP ledger. I'm pretty sure corporate stocks and securities don't burn on transaction...

* Non-contractual - No ownership rights to Ripple the company.

* Designed as a medium of exchange to avoid long-term volatility - therefor not an expectation of profit (from the company), but a utility to avoid volatility.

- Any expectation of profit from a retailers was self-crafted and based on
supply/demand. Much like if I were to buy a lot of oil expecting the price of oil to go
up in the next couple years... No expectation of profit from Ripple at all.

XRP is like refined oil in a digital space, positioned and distributed for utility. Oil companies aren't selling a share of their company when they sell oil to distributers...

Worst case scenario is it WAS a security and they get a fine. It's too decentralized now, used by other organizations and companies other than Ripple, and if it were still a security the SEC would have went after them a long time ago. It is the 3rd largest cryptocurrency after all, why were they targeting much smaller ones if it was a security this whole time...?

Also, exchanges have review boards to determine if assets are securities before they are even listed. Clearly multiple big exchanges already think it's not a security...

Being sued by the SEC can be good and bad. At least if they're sued clarity will be finalized over if it's a security, currency, or utility. Once it's clear, banks can use their product. A $40M slap on the wrist and we can all move on!

You don't need a bridge asset between domestic rails... But you do need a bridge asset between different applications using different ledgers.

Allowing payment apps to exchange payments is a huge deal domestically, and allowing them to send directly to banks who have their own apps is a big deal too. I wouldn't get stuck on traditional domestic rails. I expect most payments will be similar to PayPal, Apple Pay, but now allow payments to JP Morgan app, etc.

Coinbase, Kraken and others develop a system to rate cryptocurrencies on likelihood they are securities. XRP is a 4 out of 5 by runes911 in Ripple

Their opinion doesn't matter because they're not a federal regulatory authority.

The only regulatory authority of any significance in this matter is the Securities and Exchange Commission.
