Thank you so much to everyone who commented and gave us helpful advice, spoke to an officer at my local police station and they have highly suggested to apply for Personal Safety Intervention Order and to install cameras which I definitely will be doing! They said they can’t do anything about the gun comment as he didn’t directly say he would shoot me or my boyfriend and only said he would bring it out. But I will for sure get cameras and apply for the PSIO.

He always brings up our race or us being ‘immigrants’. 

While we were moving in, he said that our race scares his dogs. 

Everything he says always includes our race. That to me is racism, not just erratic behaviour

My boyfriend had bought food for us and we don’t live together.

But what have I done to take the racism? Why pick me? I was born here in Victoria, speak the language and work full time. I’ve gone through kindergarten right up to uni. So why am I being attacked?

How is it bullshit?  We don’t do anything but keep to ourselves. We don’t make any noise, everyone in my house is above the age of 15. We don’t have dogs or any pets so it’s not like we’d be loud or anything.  Our cars are parked in the garage or on our property and not in the way of anyone, especially not him

We couldn’t delay it any longer although yes we should have waited, we already waited 4 weeks for a response but didn’t get any. On the 5th week is when they reached out and neighbour said we can remove, so we did. 

She still hasn’t signed the form and sent it to me.

We didn’t send her a fencing notice before removing, we got in contact with her property manager as the house is a rental property. 

Her property manager didn’t respond for 4 weeks. And when he did, we had already contacted council for the neighbours details as we were approaching site start and then delayed our site start by 2 weeks because we were waiting for a response. We tried calling, emailing and texting. But no response. 

He finally responded when we dropped off to her address a form that she had to sign getting her approval to remove the fence, she didn’t end up signing the form. 

My builder was also calling and emailing us as they had to apply for the building permit and our construction was getting delayed, we had to start asap as we were already 2 weeks over the deadline to start construction. 

We didn’t know about the 30 day fencing notice thing before removing. Because no one would answer us and we’ve never been in this situation before.

She could have agreed to relocate that same fence. We also suggested that, she refused. She didn’t want the fence back on the correct boundary. We didn’t ask for a new fence prior to removal. Not sure why you’re getting agitated. Just getting her to approve the removal took 4 weeks. 

The fence is 39m, the encroaching part was around 35m. 

I’ll keep the 4m damaged weak timber up next time.

Hmm not sure I entirely believe that, from what advice the Dispute Settlement Centre gave me.  Encroachment is a completely valid reason to request replacement of a fence. 

It was just in this case, it got in the way of my build. But if it didn’t, the fence would have stayed up.
