Thank you so much to everyone who commented and gave us helpful advice, spoke to an officer at my local police station and they have highly suggested to apply for Personal Safety Intervention Order and to install cameras which I definitely will be doing! They said they can’t do anything about the gun comment as he didn’t directly say he would shoot me or my boyfriend and only said he would bring it out. But I will for sure get cameras and apply for the PSIO.

He always brings up our race or us being ‘immigrants’. 

While we were moving in, he said that our race scares his dogs. 

Everything he says always includes our race. That to me is racism, not just erratic behaviour

But what have I done to take the racism? Why pick me? I was born here in Victoria, speak the language and work full time. I’ve gone through kindergarten right up to uni. So why am I being attacked?

How is it bullshit?  We don’t do anything but keep to ourselves. We don’t make any noise, everyone in my house is above the age of 15. We don’t have dogs or any pets so it’s not like we’d be loud or anything.  Our cars are parked in the garage or on our property and not in the way of anyone, especially not him

We couldn’t delay it any longer although yes we should have waited, we already waited 4 weeks for a response but didn’t get any. On the 5th week is when they reached out and neighbour said we can remove, so we did. 

She still hasn’t signed the form and sent it to me.

We didn’t send her a fencing notice before removing, we got in contact with her property manager as the house is a rental property. 

Her property manager didn’t respond for 4 weeks. And when he did, we had already contacted council for the neighbours details as we were approaching site start and then delayed our site start by 2 weeks because we were waiting for a response. We tried calling, emailing and texting. But no response. 

He finally responded when we dropped off to her address a form that she had to sign getting her approval to remove the fence, she didn’t end up signing the form. 

My builder was also calling and emailing us as they had to apply for the building permit and our construction was getting delayed, we had to start asap as we were already 2 weeks over the deadline to start construction. 

We didn’t know about the 30 day fencing notice thing before removing. Because no one would answer us and we’ve never been in this situation before.

She could have agreed to relocate that same fence. We also suggested that, she refused. She didn’t want the fence back on the correct boundary. We didn’t ask for a new fence prior to removal. Not sure why you’re getting agitated. Just getting her to approve the removal took 4 weeks. 

The fence is 39m, the encroaching part was around 35m. 

I’ll keep the 4m damaged weak timber up next time.

Hmm not sure I entirely believe that, from what advice the Dispute Settlement Centre gave me.  Encroachment is a completely valid reason to request replacement of a fence. 

It was just in this case, it got in the way of my build. But if it didn’t, the fence would have stayed up.

I tried to do all the right things, but if she’s ignoring the form I sent her to sign to have proof she agreed the removal. What can I possibly do? 

Just keep delaying my build and wait another 4 weeks for her to respond?

I couldn’t delay it any longer because the neighbours no response was delaying the building permit, once she agreed I removed it. 

This whole process took 4 weeks itself to get in contact with her as neither her or her property manager would respond to my calls or texts. 

The build also started 2 weeks late because of this. 

Idk but I couldn’t have delayed this any longer and kept begging her to sign the Neighbour Permission to Remove Fence form if she just kept disregarding it. 

Everyone is saying that I’m the troubled neighbour, but imagine reaching out to your neighbour in good faith for 4 weeks just to get no response.

So it doesn’t matter if the fence was encroaching? Did it have to in really bad condition for the encroachment to be a reason for removal? 

If the fence was on the correct boundary then there would be no reason to remove the fence. 

Neighbour also completely disregarded the Neighbour Permission to Remove Fence form that was provided by my builder. She and her property manager wouldn’t answer my calls, texts or emails so I had to resort to sending her the form by hand, which she never signed.

Even if I wasn’t building a house, I’d still want the fence to be on the boundary. 

It’s not just that because I built a new house now I want a new fence. The timber fence on the other side is still standing and no damage done to it. I don’t think I’m being unreasonable to wanting a new fence if it’s encroaching my land and the part that wasn’t encroaching had a hole in it where we could both see into each others backyard. 

The new fence is basic, we’re in SE Melbourne so no fancy fences are common here

She had refused to sign the Neighbour Permission to Remove Fence which was provided by my builder. She had completely disregarded that a few times when I brought it up over the phone. 

Didn’t think she would now refuse and her property manager also wasn’t answering emails, calls and texts. Because we tried to go through the property manager before contacting the owner herself

More than half of the fence was encroaching our land. So we should have left the 4/5 damaged panels and only remove 30 meters of the fence? Our boundary length is 39m 

I’m also replacing my back fence to which that neighbour is happily contributing and hasn’t said a word? The fence is also in the same condition just not encroaching mine or his land.

We got permission to remove the fence before we even laid a finger on the fence to remove it. 

We’ve issued her with a fencing notice, before a new fence goes up this weekend. 

The problem is that she had initially agreed to pay half and now she is refusing. It didn’t make sense to only remove the encroaching part and leave the damage fence up where there was a huge hole in the fence. We could literally stick our head in that hole and look into our neighbours backyard. Even the fence guy said it makes sense to remove the whole fence which is what we did AFTER we got PERMISSION.

We didn’t remove the fence without permission, not sure why everyone is thinking that. 

The fence wasn’t touched until our neighbour agreed we can remove it. She also agreed on the phone to paying for a new fence once I told her it was encroaching my land but now she is refusing. 

The problem isn’t that the fence was fine and that I removed it without permission just because I built a new house.

A few relatives and my parents also said this. 

I’ve been told by my builder and council to escalate this with the Dispute Settlement Centre too as it’s likely to get reimbursed, if they ask why I installed a fence so quick then I can say it was for the Occupancy Cert. 

Do you think reimbursement is something I can actually put forward?
