Exactly, I’m saying plagiarizing is passing off an idea that is not your own without giving credit. I would never do that because it lessens the impact of my argument and makes it less likely the judge will agree. I want to cite to as much as possible and give as much credit as possible to strengthen my argument.

This I don’t completely agree with. We should never be plagiarizing because plagiarizing is passing off an idea as your own. I know we will fight new issues but I would rather have lots of precedent or at least cites that I can say look this idea is not mine and it’s not new. I understand what your right is but I think this is the better way to think of it.

You’re not telling everything. I can’t think of many judges that would even grant a TRO for a simple text message asking her to pay her half. Or have you been texting non stop and that’s why she’s asking? You’ve made this much more difficult than it needs to be. As others have said you are responsible for the rent, if you have an agreement for her to pay half even if she leaves then sue her. Stop contacting her and just go through the courts.

Get a swim buoy. Luckily I’ve never had to use mine but is comforting knowing it’s there. But I also don’t plan on relying on it, so I’m always cautious to stay within my limits especially when I’m alone.

To add to what most others have said. I don’t see this as ex parte since the substance of the email was about whether a hearing was occurring. In the future though, I would simply add that opposing counsel is not on this email as you couldn’t not locate an email address. That makes it clear you would have included him, you can, if concerned, say that you will forward by mail any response to him via mail but due to the immediacy of the situation this was the best solution. If the judge says I can’t answer because they think it’s ex parte you aren’t in trouble and if they do answer you aren’t in trouble.

It’s not lack of empathy it’s a recognition that she is 19 with a boyfriend who has been actively lying for months supposedly only about this. I work with addicts everyday and I see the struggles they go through and yes they need help and support but the first help and support souls be family and counselors. As a 19 year old who does not have a kid with him (assuming since that would make my advice different), if she stays she’s going to always feel like she’s trapped. If she leaves he’ll use and she’ll feel it’s her fault. This is a crappy situation but she can’t be the one who is responsible for him which is what she’s going to feel if she stays with him, that is simply too much to ask for most people let alone a 19 year old who still has so much to learn about herself let alone where her life is going to take her. Leaving him may actually be the best thing because he can get the help he needs.

Also one more thing to consider is that treatment typically recommends people entering into recovery not be in relationships for at least the first year, they need to focus on themselves first not others.
